Lacrosse players face old charges (Nifong retaliates against Duke Lax)

DURHAM - District Attorney Mike Nifong plans to reinstate misdemeanor charges against a half-dozen Duke lacrosse players, saying a March 13 party where a woman reported a rape broke the deals that the players made with prosecutors.

Nifong's decision could affect players who, before the party, had entered agreements in which prosecutors would dismiss the cases if the players performed community service and stayed out of trouble for six months or a year. Among the first to have his charges reinstated was David Evans, one of the team captains who lived at 610 N. Buchanan Blvd., the site of the party in which lacrosse players hired two women from escort services to dance. One of the women told police that she was raped by three men in a bathroom.

Two players, Collin Finnerty, 19, and Reade William Seligmann, 20, were charged last week with first-degree rape, first-degree sex offense and first-degree kidnapping. Their attorneys say the men are innocent.

On Monday, an attorney for Seligmann filed a motion seeking information that would help attack the credibility of the woman, the only person, according to the defense filing, who says a rape occurred. The motion seeks information about the woman, including criminal charges, mental and emotional problems the woman has suffered as well as social services, probation, child protective services and victim's advocacy records.

Today, Finnerty is due in a Washington court where prosecutors in an assault charge are considering whether to revoke a deferred prosecution agreement similar to those affecting other players in Durham.

According to court records, 16 players were charged in the past three years with misdemeanor charges in Durham including noise violations, public urination and alcohol violations. The deals placed the men on probation for either six months or a year.

The prior incident with Finnerty required that he stay out of trouble and not get arrested again. The problem is that he got arrested again. However, it may be a false arrest, and he needs a reasonable amount of time to clear the charge against him. It is possible that he has stayed clean of problems, and that he may have avoided the party because of his prior arrest.

The DC Feds need to take a step back and give him a chance to prove that he has been falsely accused, and agree to a continuance of the case until after the Durham charges are resolved. For goodness sake, the case in DC is a friggin misdemeanor and with the workload of the Federal Courts you would think they could put it on a back burner and concentrate on the serious cases confronting them!

Thanks to the publicizing of the results of Collin Finnerty's room search, FNC arrived at a Boston College dorm looking for Finnerty's girlfriend. Boston College Authorities kicked them off campus.

This was my thought why Finnerty was probably at the Mexican restaurant rather than the LAX party.

another legal question--Can Nifong insist that players cited for other offenses prove they weren't at the party? Shouldn't he have to prove they WERE at the party?

If the guys were cited before, they may have entered a plea called a "Prayer for Judgement" or a PFJ-6, meaning they have to keep clean for 6 months, or they will be penalized for the original infraction PLUS the new one. The charge is wiped off the record after the 6 months period, as if the infraction never occurred. This is common in North Carolina, specifically on such things as speeding tickets, etc. but can be used on almost any case. It's sort of a "Guilty, but can I have 6 months probation and be good, and make this go away?"

Like I said before....I have three sons. I have taught them well and I have hammered in to their heads women are not sex objects, chicks, babes, hot, whatever.

Testosterone undoes it everytime.

Anyone with normal teenaged or young adult boys knows it could be anyone of our sons.

I would be his worst nightmare.

The boys may have been stupid, but that is not why this has snowballed.

I would think they need to be proven there. The only thing I can think of is maybe their parole/probation/PFJ agreement requires them to account for where they are at all times, which seems ridiculous. It's not like they were convicted of a major crime and were required to wear an ankle bracelet.
