- Can a DA or any public prosecutor for that matter be successfully sued for malicious prosecution? I was under the impression that persons in such positions were exempt from being charged.

MALICIOUS PROSECUTION, or MALICIOUS ARREST, torts, or remedies. These terms import a wanton prosecution or arrest, made by a prosecutor in a criminal proceeding, or a plaintiff in a civil suit, without probable cause, by a regular process and proceeding, which the facts did not warrant, as appears by the result.

No DNA...a DA facing an election. No eyewitnesses, and victims of questionable character. Maybe these kids will graduate and retire.
