Case Aganst Duke Student Unraveling Fast

Breaking overnight from Chris Cummo at ABC GMA:

Case against at least one Duke defemdant unraveling fast.

Defendant Seiligman went to bank ATM while rape supposedly happening.

12:02 Time stamped photos show girl arriving. Girl leaves, comes back, call friends on cell phone does other things. 12:19 Seiligman calls cab dispatcher 12:24 Seiligman takes cab to bank miles away, uses ATM card (photos show it is him.) 12:42 after walking back to dorm, Seiligman uses security card to enter dorm. Does not leave.

Also, Seiligman was never interviewed by cops. DA seeking reelection simply took "Dancers" word that he raped her.

Guest: We don't know when the party started because the boys refuse to talk to anybody. Why did they flee a party? I agree with Wendy. something was wrong at this party. Regarding the cab driver's log - I don't find that persuasive. It could be legit or not legit.

If the venue isn't changed, they'll be convicted after an hour of deliberating.. I think the O.J. jurors thought about a 8 month trial for 60 minutes.

They are guilty in Durham, no doubt.

I can't get MSNBC from my hotel room, but it sounds like these guests haven't seen the photos or read the timeline.

Now, this guy thinks the cabbie is a liar, too.

That panel was so biased against those boys. And I can well imagine that those guys were a little freaked out about the whole scene with the strippers, an argument, her being so drunk she's falling off her shoes, trying to get rid of her, I'm sure her threats of calling the cops and they know they're underage and drinking.

Could, must and will. Every time an identification is presented in court, a judge must first do a hearing out of the presence of the jury to determine if the identification is reliable enough to go to the jury. There are several factors, but one is the quality of the lineup. If the lineup is not proper (and a lineup only of team members would not be), the judge must suppress it. What's more, the accuser will not be able to identify the defendant in court if she viewed him in an improper lineup (unless she had prior familiarity with him). Without the identification by the accuser, the odds of the judge directing a verdict of acquittal before the case gets to the jury are very high. Only something as unequivocal as a DNA match could save such a case from DV.

In the world of prosecution, a lineup with only team members would be a BIG boo-boo. Laughable, actually. I hope the reporter got some bad information on that one.

Rita's about a day behind the pajama army. The Herald-Sun printed that they contacted 12 cab companies and none of them had any cabs there. The problem is that there are at least 30 cab companies in the Durham area. One of Rita's interns misinterpreted the H-S article, which I suspect may have been worded purposely to begin with.

Are you saying a judge can toss this case? I've been looking for some clarification on this matter.

And yes, I did mean "DISCIPLES". ;{

I have heard it said the season was canceled because of the rape allegation, and I have also heard it was canceled because of the stripper party held at a University-owned house. The latter might be a proper (albeit harsh) disciplinary action over an undisputed event.

I remember a "crackdown" in college town of U Berkeley, similar to this and because of whatall was going on in the frats, dorms; but MOSTLY the private residences around the campus. I think the penalty if busted was no admittance or no grades. Long-term, it did no good.

These youngster will mimic their "stars" and their "celebrity-ites".

Two friends of Seiligman's on the show. Did he talk about the party at all, Rita asks.

Friend: Said it was crazy and strippers locked themselves in the bathroom for a period of time and he left after that. He said the strippers were doing drugs in the bathroom.

Other friend: They were concerned because of thes tate of the stripper and a dispute about paying her and her pimp would come after them. It had to do something about money.

First friend: They danced for 4 minutes and the guys didn't want to pay all that for 4 minutes. After 4 minutes, they went into the bathroom. I'm best friend with Reed's girlfriend and she talked to him, of course. Of course, he must be distraught over this situation but he's taking it calmly because he know he didn't do anything wrong.

Actually we now just heard on Rita what the lacrosse players were telling their friends.

Sounds like they didn't pay the strippers, and were thinking the pimp (probably armed with more than a lacrosse stick) would come after them at the house for the money.

THAT'S why they cleared out so quickly, not fear of law enforcement showing up as Wendy Murphy claiming.

Damn Rita's show was disgusting the first segment. She made a bigger deal that the cabby went to the house a second time said one of the players said, "She's just a stripper." BUT the cabby said he sounded MAD.
I think the guy was talking about the slurs and Kim calling 911 not a RAPE.
