Breaking overnight from Chris Cummo at ABC GMA:

Case against at least one Duke defemdant unraveling fast.

Defendant Seiligman went to bank ATM while rape supposedly happening.

12:02 Time stamped photos show girl arriving. Girl leaves, comes back, call friends on cell phone does other things. 12:19 Seiligman calls cab dispatcher 12:24 Seiligman takes cab to bank miles away, uses ATM card (photos show it is him.) 12:42 after walking back to dorm, Seiligman uses security card to enter dorm. Does not leave.

Also, Seiligman was never interviewed by cops. DA seeking reelection simply took "Dancers" word that he raped her.

To be honest, with divorces it's all very hard to sort out.

I know people that had that exact problem.

There is some guesswork in it, unless she voluntarily fills out a form - and you can't believe her anyway.

Hate to tell you this, but in most states (including, I am pretty sure, North Carolina), any citizen can go to a judge (usually a magistrate) and swear out a warrant against another. The accused would be arrested and taken to jail in most cases, though usually released on personal recognizance. As long as we cannot prove they intentionally lied, there would be no penalty for bringing a false charge in that way. We have such a procedure in my state, and I hate those private individual warrants. They are usually obtained in cases where the police declined to act.

That last statement brings to mind a former detective who was a "talking head" on Orielley tonight. He said the police in Durham wanted nothing to do with this case. The lack of police comment is something I should have noticed a while ago. Usually the police instigate a case through serving an arrest warrant they obtain themselves from a judge. That did not happen here. Looks like the D.A. is way out on the end of a limb by himself.

Is she correct in saying that the defense attorney could have presented the alibi to the grand jury? I thought these defense attorneys and lacrosse players weren't called to the grand jury.

O'Reilly has a very good reason to be wary of allegations of sexual abuse or sexual harassment. I'd be tepid as well. I haven't watched him for a while, but I caught his interview with Al Sharpton last night about this case. Guess which "rape" case Oh'Really didn't ask Al about.

I think that's someone else with the same name. Someone posted a website entry by a 16 yr. old Raleigh girl with the same first, middle, and last name. This sounds like her.

I've read so many posts that I cannot even remember now what time this alleged rape took place.

The picture of her at 12:30:47 shows her wearing pink fingernails...yet the DA states:

the victim’s four red polished fingernails were recovered inside the residence consistent to her version of the attack. She claimed she was clawing at one of the suspect’s arms in an attempt to breathe while being strangled. During that time the nails broke off. "

These cases drive me nuts!

I don't follow your logic.. DA Nifong went on many shows and said the money was found CONSISTENT with her story.

We know NOW they found $160 some dollars.

I think this shows clearly that the investigators and the DA use the term CONSISTENT loosely and with their theories.

Kerry Sutton said yesterday that they tried to get Nifong to meet with them and SHOW him this evidence and the pictures and let him talk to their clients, but he refused.
