Is rape of a drunk woman something other than rape?

How could there have been a rape if there is no DNA.

In many rape cases no DNA is found (sometimes the rapist, for example, washes the victim or goes through some other bizarre rituals). However, from the way the victim described the rape in the Duke case, there should have been plenty of DNA. On O'Reilly and others shows, they stated that the lack in this case exonerated those accused.
