I am by no means a legal expert, but doesn't this open the door for the defense to get access to Barry's medical records? How about access to grand jury testimony? How about calling Victor Conte? It sounds like Smilin' Barry's lawyers have opened Pandora's box. At the very least, I think they've just given the book more publicity.

This lawsuit is actually a tacit admission of Bonds Guilt.

Notice, they are not suing for Libel or slander, they are suing for the authors using grand Jury testimony in the book.

IOW they cannot refute the facts, so they are nitpicking at how the facts were presented.

My opinion, this lawsuit is just a smokescreen. This allows him not to answer questions from reporters about steroids. He'll say to reporters,"I can't comment because of pending litigation". This is another "f" you to the press from Bonds. This suit will go away once Bonds retires. No way Bonds will testify in front of a jury and allow himself to be opened up to questioning. I don't think a jury (unless it's in San Francisco) will buy the argument that it was just flaxseed oil that allowed him to put on so much muscle so quickly.

If the authors should forfeit all profits because the transcripts were "illegally obtained" maybe Barry Bonds should forfeit all his baseball profits as his homeruns were "illegally obtained" and the steroids were "illegally obtained".
