A bigger obstacle than "the lawyers" is that the political will to eliminate these programs has been slyly eliminated by the fact that millions of people have already had huge amounts of money lifted from their paychecks to fund Medicare (and SS), and so don't have their money in their possession anymore. They know can't make their own free market medical choices with money they don't have, so they won't vote to discontinue the program.
