Jackson's lawyer may sue District Attorney

THE defence lawyer who won Michael Jackson his freedom is believed to be considering suing the Santa Barbara District Attorney for “malicious prosecution”.

Thomas Mesereau Jr is also said to be demanding that the defeated prosecutor, Tom “Mad Dog” Sneddon, give back the photographs taken of Mr Jackson’s genitals during a 1993 investigation into abuse claims.

Mr Jackson said the photographs, taken by detectives, were one of the most humiliating experiences of his life. His legal team are believed to fear that Mr Sneddon may leak the images to the public in revenge for losing the case.

The photographs were taken on Christmas Eve in 1993 after Jordy Chandler accused the singer of sexual molestation. Mr Jackson, 46, later settled the case for a reported $20 million. Mr Mesereau now says the singer received bad advice and should have gone to trial.

“Why will you not end this, Mr Sneddon, once and for all?” one of Mr Jackson’s legal advisers told the Drudge Report website, after asking for the photographs to be returned. “Do you enjoy them?”

At Mr Jackson’s trial, Mr Sneddon asked the judge for permission to enter into evidence the photographs of the singer’s “splotchy” penis. Permission was denied.

Mr Mesereau said on CNN’s Larry King Live that he was sure there was a case for malicious prosecution.

Asked if he thought Mr Sneddon’s case was malicious, Mr Mesereau replied: “I do. I think that he was treated in a way that no one else would’ve been similarly treated. It was because he was a mega-celebrity.”

That's right. They can't afford to go to trial again, even if it is a civil case.

Jackson should just get down on his knees and thank God for this verdict and leave well enough alone. Stop sleeping with little boys and mend his ways.

I would think that it would be difficult to proceed with the civil suit discussed here. I don't know the law of California, but in many jurisdictions, prosecutors have qualified immunity in bringing criminal actions. Now, if the prosecution pulled some shenanigans in bringing the charge and intentionally misled the grand jury, they might be in hot water.

The fact that a grand jury found probable cause to issue an indictment pretty well defeats a claim for malicious prosecution.

As another poster mentioned, a civil suit could be the last thing that the defense in this case wants.

My prediction is that this is just sword rattling.

I hope this is true.

Remember Alger Hiss had also successfully dodged the bullet, until he sued Whitaker Chambers for liable.

And that's when Hiss' story fell apart putting him in jail.

Pride comes before a fall.

Oh, please. If Jacko files a civil suit, the prosecutor can justify his decision to prosecute by introducing evidence that was deemed inadmissable during the trial. Jacko would get skewered in a very public way. No way a maliscious prosecution case gets filed.

Also...today I heard about the "Reality T.V. Show " being hawked by the Jackson family that apparently no networks have accepted so far. What I didn't know, was that while the trial was ongoing, the stupid family, always standing up for their dear brother, .....cough....were FILMING THEMSELVES daily as they went through their TORTURE and STRESS !!!

I am telling you..Ya can't make this stuff up!!
