We Americans are the ultimate arbitrators as to what is constitutional, not the judges,IMHO. Oh, I completely agree. Frankly, I think our Founding Citizens were suckers to fall for the Constitution, the meaning of which could be changed at any time by 5 out of 9 lifetime political appointees.

They didn't fall for that. The Supremos self-appointed themselves arbitrators of the Constitution's meaning in Marbury v Madison in 1803. Its just that noone has called them on it.
