APRIL 28--One of the five remaining "American Idol" finalists was once arrested for felony cocaine possession, but had the charge--and a separate marijuana count--dismissed last year after completing a so-called "diversion program," The Smoking Gun has learned. Harold "Bo" Bice, 29, was busted in June 2001 by Huntsville, Alabama cops and hit with the drug count, a Class C felony, according to the below warrant. He was arrested again in July 2003 near Birmingham and charged with marijuana possession, public intoxication, and possession of drug paraphernalia, according to court records. He pleaded guilty to the latter two misdemeanors in December 2004. The pot charge was dismissed after Bice's successful completion of the same diversion program that covered his prior cocaine bust. In that 2001 case, a District Court preliminary hearing was set for August 29, but when a Huntsville Police Department investigator did not show, Judge Susan Moquin dismissed the Bice case, according to a court docket. But with prosecutors prepared to refile the felony count, Bice later opted to enter a drug diversion program overseen by the district attorney's office, according to Heather Douglas, spokesperson for the Madison County D.A.. Bice formally entered the diversion program in 2003 following his pot arrest, and the two separate drug possession charges were effectively merged and covered by Bice's diversion program, according to a TSG source familiar with the cases (the cocaine charge was bounced on April 28, 2004, and the pot rap was dismissed five months ago). Bice was arrested on the cocaine charge after scoring about 1/2 a gram of the drug from an acquaintance at Huntsville's Silver Dollar strip club, according to a source. If convicted of the felony coke charge, Bice would have faced a maximum of 10 years in jail, though a probationary term would have been more likely. While details of what Bice had to do in the diversion program are confidential, enrollees usually must submit to urine tests, undergo drug counseling, and attend awareness classes. Bice, who worked at the time in a Huntsville bar, is a long-haired rocker whose gritty appearance and performances have stood out from "American Idol"'s usual pop pablum. On Fox Television's "Idol" web site, Bice reports that his "most embarrassing moment" was when he once "fell off stage during a show."

I wonder what she was doing that caused him to get custody? Maybe she was doing that in front of the baby and that's why he wanted the baby away from her.

Scott acknowledges the role of Christ in his life. He not only did what he was ordered to do by the court, he got himself together and is now a state corrections officer with custody of his child.
Bo committed a felony. He was arrested TWICE for drug usage. This was fairly recent. He may or may not be clean now.
Scott was not convicted of assault. He pled no contest to DISORDERLY CONDUCT.
If you are willing to give Bo a pass for committing a felony, just because he goes to church now, then Scott should get at least that.
Scott goes to Church also. Scott has custody of his son. Scott has a good job.
Bo is a 30 year old rocker with a drug habit.
Bo's felony bust was 4 years ago - his most recent, the pot bust - was 2 years ago. You either have a reading comprehension problem, or you are deliberately lying about Bo's situation in order to defend Scott. Why can't you accept that BOTH of them may have turned their lives around? It doesn't have to be one or the other! I understand your bitterness concerning your brother's situation, but that has nothing to do with Bo.
I have no bitterness towards Bo. What I am really ticked off about are the hypocritical jerks who have been tearing Scott apart but immediately excused Bo.
I don't care if Bo wins personally. I just hate the fact that we have freepers who don't want to give Scott the same credit for turning his life around.

The fact is, Bo has just wrapped this whole thing up only MONTHS ago. Scott's situation was resolved YEARS ago.
There are no untruths there.
I'm not the one who has trouble accepting that they both have turned their lives around. I have said as much, but you don't seem to want to acknowledge that.
Acknowledging BOTH of them is what I have been trying to get others to do.
But there are lots of hypocrites who don't want to do that.

He has been beyond hateful about Scott. That is why there is so much of my energy directed towards that particular poster. That was also the latest post in a series of posts back and forth with that poster.
I don't go off on someone without reason. You don't seem to have the same restraint.
One last thing. I have no bitterness about my brother's situation. He did that to himself.
It has nothing to do with me. Because of the behaviors that are common to most addicts, I have kept my distance from my brother for a long time.
One final time, my problem is the hypocrites.
So you are making a big deal out of the fact that I got it backwards about WHICH DRUG he got arrested for

Okay, so I got the drug wrong. Big deal. But I didn't get it wrong that he was arrested twice for drugs. You are calling me a liar based on the fact that I got the cocaine and pot backwards?
The fact is, Bo did drugs. Bo got arrested for drugs. Bo's plea of guilty was only 4 months ago. I'm very clear on the fact that the arrest was in 2003.
If you are so interested in what I have to say, then you need to go back and find out that I told Xenalyte that the arrest was in 2003.

That is why I said his case was more recent. Look, both of Bo's cases were more recent that Scott's.

I will apologize for suggesting that you might be lying; apparently you were merely mistaken. However, you should be clear on your facts before SHOUTING THEM OUT on a public message board.
Like I said before, I wish both of them the best and I hope they both have a great career in music. But what's good for one, should be good for all.
