What should the President do about Schiavo? (legally/vanity)

Judge George Greer, the Supreme Law in the State of Florida, has removed all of the abilities of Governor Jeb Bush to save Terri Schiavo. I don't know that anyone could save her at this point; a week of dehydration may have done irreversible damage. Still, we must try.

The Fourteenth Article of Amendment to the Constitution of the United States, states,

Section 1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside. No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

Section 5. The Congress shall have power to enforce, by appropriate legislation, the provisions of this article.

Congress is so lethargic and dominated by pro-death Democrats that it surely will not exercise its power in a reasonable time, and its last attempt ended in failure. Contrary to the orders of Judge Greer, Terri Schiavo is not (medically) a xerophyte who can wait until next year for some water. She desperately needs water today.

Florida is bound by the Fourteenth Amendment, and the federal government required the state to accept this article to regain its status as a state after the American Civil War. The State's obvious flouting of its obilgations under the Fourteenth Amendment should rescind the provisions of the Compromise of 1877 that lifted the federal military occupation of Florida during the Reconstruction after the Civil War.

The Congress should have exercised its delegated (Article I, Section 8) power "To provide for calling forth the militia to execute the laws of the union, suppress insurrections and repel invasions." Moreover, "The President shall be commander in chief of the Army and Navy of the United States, and of the militia of the several states, when called into the actual service of the United States" (Article II, Section 2). The President also swore or affirmed that he would "to the best of my ability, preserve, protect and defend the Constitution of the United States" (Article II, Section 1).

These powers should allow President Bush to declare a judicial insurrection in Florida, and thereby to call forth both the Florida National Guard and any regular troops in the vicinity to suppress this insurrection.

Suppressing this insurrection must involve--at minimum--rescuing Terri Schiavo and airlifting her to a military hospital in another state. The troops also must hunt down Judge George Greer, Attorney George Felos, and adulterer Michael Schiavo, the triumvirate who started this incurrection.

Alternatively, the President could use the José Padilla precedent to declare Terri Schiavo an enemy combatant. While this action would remove the jurisdiction of the Courts over Terri Schiavo and remove her abusive husband from the equation, it might set the Padilla problems on even more shaky grounds, and I do not advise it.

The Bushes and the Congress are too busy outsourcing america and handing it to illegals for profit to worry their useless selves with upholding the Constitution on this. They have failed to with regard to immigration and trade, why bother with anything else. This nation is in an undeclared state of war.. with itself.

Many the VA patients I know are scared to death they will be next on the "put to death" list. What else do you think dependent disabled persons would think after this? They have to deal with the present reality also. And many of them have been able to "roll their little wheelchairs over to their computers keyboards" and make their opinions known or do you have them figured as brain dead too?

Good luck. There will be no action from the House or Senate until Monday, and that's not likely because they are all out playing in their Districts until ONE WEEK FROM Monday.

Sometimes I think that if this were "President Kerry" this matter would have resolved last week and Terri would be under Federal protection at the nearest Mayo clinic.

You need SERIOUS psychiatric help if you really believe this.

Kerry's a poster child for the Culture of Death, although he doesn't show up too often at their meetings...travel, you know. Ter aaaaazzzah needs him in Italy, Montana, and Spain.

Her parents lawyers also neglected to get an attorney ad litem appointed for Terri, and neglected to appeal the Judges ruling on that issue in a timely manner.

Under those circumstances Judge Greer had no choice but to rule as he did. The correctness of his ruling at law is shown by the fact that he has been upheld close to 30 times on various appeals.

Nice defense of "Process"--but not of the Law as handed down from Mt Sinai.

You get a zero.

The Governor of Florida, Jeb Bush, can stop Terri from starving at ANY moment.

By Article IV, Section 8, of the Florida Constitution, Jeb Bush has the power to "restore civil rights." All he has to do is issue an executive order.

The governor can restore the rights of ANY PERSON at ANY MOMENT. (Exceptions for treason and impeachment noted.) This is a BROAD power. It is broader than his right to pardon.

And yet, even his right to pardon applies here. By order of Judge George Greer, Terri was ordered to starve to death. The way the order was written, Michael Schiavo could not even change his mind. He was ORDERED to starve his wife to death. That is a death sentence.

Gov. Bush has stated publicly: “I am doing everything within my power to make sure that Terri is afforded at least the same right rights that criminals convicted of the most heinous crimes take for granted.” He has also said he would “exhaust all executive options . . . to save Terri’s life.”

Jeb Bush could pardon her, the way he would any wrongly convicted person, under the same article cited above. Or he could simply restore her rights.

This power cannot be controlled or obstructed by the judiciary.

Sorry, but civil rights include the right to vote, participate otherwise in the political process, and hold public office. They do not include the right to life, which the Creator endowed to all persons. The Governor cannot restore the right to life (except by pardoning a person who violated that sacred right of another) because the Governor does not grant that right. The Supreme Court has also ruled that life is a criminal right of teenage killers, but that does not protect civil persons or even non-persons.

But this judge insidiously declared that Terri is not a "person" put a plant (apparently a xerophytic cactus who can wait until next year for some water without any harm). That irrevocable ruling stripped Terri Schiavo of the rights endowed by the Creator to all persons, because it is not a person.

Terri is not the first human being declared to be not a person by the Courts. The Supreme Court first tried this trick in 1857, when it declared Dred Scott to be an animal because of the color of his skin. The Court also decreed in 1973 that unborn babies were malignant tumors rather than persons, and as such could be "aborted." So there's plenty of precedent for declaring humans to be "not persons" and therefore not endowed by their Creator with the certain inalienable right to life. After all, the Culture of Death rules the Courts, who in turn rule America without question.

Remember, the fundamental purpose of government is to secure the inalienable right to life endowed by our Creator to all persons (Declaration of Independence, Thomas Jefferson, 1776).

I don't blame President Bush, but Governor Bush, who has all the tools he needs in the state police and the National Guard to save Terri Schiavo.

Since the court rulings have been affirmed at the federal level, what you are talking about is armed insurection against the government of the United States.

Why settle for a war on terror when we can have a Civil War and kill hundreds of thousands of ourselves and save the Muslims the trouble and ammo.

You can't tell the difference between a criminal conviction and a ruling in a civil custody proceeding?

The power of pardon no more applies here than it would to pardoning someone from child support payments ordered in a divorce.
