Florida residents/attorneys: File a RULE 1.290 DEPOSITIONS petition
1l | 1l

Posted on 03/24/2005 2:09:17 PM PST by 1L

The Florida Rules of Civil Procedure allow a deposition to be taken prior to a civil action actually being filed. Filing and serving this on Terri, and asking the court for an order inserting the tube so as allow the witness to live in order for the deposition, may be a last, best hope. It's clear Jeb isn't going to do anything.

You'll have to come up with a cause of action.

That's simply not true! He, more than anyone else in Florida, is ultimately responsible for upholding the laws of the State. And there are laws that are being violated in this case. He is as complicit in this murder as Pilate was in the crucifiction of Jesus. I'm tired of elected officials, even Pres. Bush, saying there is nothing left to do. They have the Constitution behind them. It is criminal. Is there no one that will uphold the principles of life anymore? Look at all the people that are allowing this to happen, police, legislatures, judges, executive officers, DCFS, lawyers. These are the people that we rely on to keep our system running as it was intended. Guess what? I think that this country is headed for chaos, and soon, because those that are supposed to govern and protect are not doing their job anymore. I think it is something like, protect the guilty and punish the innocent.

Mikey is her guardian...he gave the order of no food or water. In the past, he's also ordered no atibiotics for infection. No therapy. No going outside.

of course he can. as andrew jackson said about the chief justice of his day - "he's made his decision, now let him enforce it!". what's judge greer gonna do, arrest jeb? arrest george bush? that's foolishness. of course they could do this.

That's the attitude of every third world dictator: "Screw the law, I've got the most guns."

Jeb would be held in contempt for violating the judges order.....he could be arrested and handcuffed. I heard that on Hannitys show from Sekelow(sp)

It's the end of the legal road here and I suspect Terri is also at the point of no return.

you obviously don't care whether this "husband" of hers has been trying to murder her for 15 YEARS

He has gone through legal channels the entire time. Michael Schiavo has never tried to murder his wife.

there is a big stinking pile of evidence, including affidavits, that judge george greer has been sitting on for years and suppressing. why specifically - i don't know

He excluded some evidence from trial. That's perfectly normal.

maybe he's getting paid off.

That is just baseless libel.

but the evidence is there and it's more than enough to warrant removal of michael schiavo as guardian - hell i think he should be under arrest at this point!!!!

Something like 20 courts have reviewed this case and have fiund that Michael is the appropriate guardian here.

I'm no authority but to the best of my knowledge Jeb can and probably should do the following:
1. Call the hopspice and tell them he is sending the FDLE to pick up Terri.
2. Put Greer in custody.
3. Tell the FDLE to advise all other law enforcement to stand down and let the FDLE, with assists from FHP as necessary, to rescue Terri and place her in a secure location.

Sometimes, the law leads to decisions we don't like. That doesn't mean we have the right to disobey it.

Even a guardian cannot legally prevent a person from eating! That is called abuse and neglect and is a crime. A judge may be able to order a feeding tube removed but after that I cannot think of any legal authority that would allow anyone from helping her to eat and drink on her own! If either Bush is looking for a way to help Terri why not challenge this inhumane judge on this?

He cannot do any of these things. He is the governor, not a dictator.

ANd who the hell is going to handcuff and arrest Jeb. FDLE is the highest law enforcement agency in the state and they answer to Jeb. And if they go Federal, there is his brother, that argument does not fly.

He should have the right or responsibility to save the life of a FLa. citizen who can not fend for herself. If that is being dictatorial so be it.
