Congress does have the power to determine the jurisdiction fo the federal courts, and they extended jurisdiction to this case.

And the judiciary has the power to decline to act, which is what it has done.

They totally ignored executive and legislative intent, which is the purpose of the law. No, they were arrogant and unresponsive, because of a pre-ordained agenda. They were not acting judicially.
