This federal judge in Tampa seems to be dragging his feet. Terry is starving. Are there any appellate lawyers out there who can tell me: Can Gibbs, the Schindlers' lawyer, make any kind of appeal to the 11th circuit in Atlanta before the district judge makes a ruling? If the judge stalls and stalls, the case will be moot because Terri will be dead. Is it possible to make an emergency appeal - at least for food, water for Terri pending a decision on the case - without a formal decision to appeal from?
I think the situation is that all relevant papers have already been provided to the Appeals Court in Atlanta so the justices can be prepared to rule quickly when the appeal is filed.
The higher the pedestal on which you stand, the harder you will fall.
The IRS doesn't give a crap about Terri Schiavo.
BUMP
If we tried to starve and dehydrate criminals to death, I think there would be many screaming that this was cruel and unusual punishent. So why is it okay to use this method to kill Terri?
I think they annul when they want to nowadays. That aunt of mine that had two annulments, also had three kids fron one of her marriages that was annuled. I think they also anull in cases where there may have been abuse. That wouldn't explain the her second anullment though. And the guy she married had his marriage anulled, too. But you may be right that a divorce comes first.
That is a prerequisite to joining the Democrat (Socialist) Party.
I'm not clear on whether you're talking about civil annulments or church annulments. (My whole familiarity -- such as it is -- with civil annulments depends largely on old movies and novels. I don't know anyone who's ever gotten one or even sought one or even mentioned the possibility. It's church annulments that have been in the news lately, what with Kerry and the Kennedys.)
My sentiments as well. As I watch the proceedings of a "stacked deck" against Terri, I admire the self control of her father and brother.
If it was my daughter or sister, at the risk of life in prison or death, Michael Shiavo and the tin-horn judge would be meeting their destiny at my hands.
I may have, but somehow I do not remember any other topic getting this heated.
thanks for sending that brief. hope they've got a good panel at the 11th.
Oh, I'll bet they've got some people monitoring this situation to make sure they get their share when the starvation is finished.
Looks like it's in God's hands this morning. Prayers for Terri and her family.
FYI --
All the docs are up at FindLaw.com, including 11th's 32-page opinion & dissent. See footnote 6, p. 10. Schiavo has to petition for en banc hearing by 10 AM EST (about 1-1/4 hrs. from now). Don't have to. Can go right to S. Ct.on petition for cert. Semper fi.
