YOu know as well as I do that we'll never know if he did rape her or if she is lying - she could have had sex with someone else and NOT have been torn - chances are that she willingly allowed this to happen then decided to cry rape - for whatever reason who knows...but I don't believe, and you can't prove, that just having had sex proves his innocence....

of course his innocence cannot be proven! our system only requires that GUILT be proven! i think she got more than she bargained for, in the act itself and changed her mind midstream. imo that should not constitute rape, though i recognize that in some jurisdictions it does.
