Illinois Gov. J.B. Pritzker signed House Bill 5093 on June 26, expanding eligibility for in-state tuition by allowing certain students who attended an Illinois high school for at least three years to qualify for resident tuition rates even if they later established residency outside Illinois before enrolling in college.
The legislation changes Illinois’ in-state tuition requirements by extending eligibility to students who meet the high school attendance requirement regardless of whether they established residency outside Illinois before enrollment.
One of the bill’s sponsors, Democrat State Sen. Celina Villanueva, said the legislation is intended to benefit illegal aliens and transgender-identifying students.

Opponents argue the legislation expands taxpayer-subsidized tuition benefits beyond traditional Illinois residents.
Republican State Sen. Sue Rezin said in a press release that the legislation “stretches the definition of Illinois residency and expands taxpayer-subsidized tuition benefits to individuals who may no longer live in Illinois, including some noncitizens.”
Rezin also argued the bill “overlooks in-state students and could pave the way for noncitizens to receive taxpayer-subsidized tuition benefits ahead of students who live in Illinois legally and are already struggling with rising college costs.”
The Illinois Policy Institute analyzed in-state tuition data from the Education Data Initiative, which reveals that “in-state tuition and fees in Illinois ranked second-highest in the Midwest and ninth in the nation in 2025.” At the same time, “overall enrollment at Illinois’ dozen public universities has declined, with the system serving about 13,000 fewer students than it did two decades ago.”
This has led Republican State Senator Jason Plummer to oppose the bill on grounds that “legislation like this will only increase that number. It will push more of our young minds to other states.”
Campus Reform previously reported that Illinois policies providing taxpayer-funded scholarships, grants, and stipends to illegal aliens became the subject of a lawsuit filed by the U.S. Department of Justice under the Trump administration.

Simply cut all federal funding to these schools. Then the state will have to prioritize its own dollars.

Pritzker is doing all in his meager power to maximize dem effectiveness in Illinois. He wants the dem nomination for president in “28”.
Well, given the fact that Illinois is loaded with cash, and has a surplus and needs to get rid of some of their extra $$.. this might be a good place to place the cash. Of course they could just give the $$ to the University of Illinois and just lower tuition for those who do pay taxes..
There is existing federal law requiring that any state that grants in-state tuition must also grant it to out-of-state Americans.
Yet nobody, Republicans, out of state students, ever go to a court to enforce this provision. Instead, they make out of state Americans to pay more to take care of these illegals.
Wake up, you students. Sue these states. Wouldn’t it be nice to see a headline “ A federal judge today ordered states to grant in-state tuition rates to all American students not residing in . . .”
