California Must Pay $1.3 Million in Fees After Newsom’s Gun Advertising Ban Is Struck Down

On March 17, 2026, in the United States District Court for the Central District of California, the court certified a settlement between the Attorney General of California and the plaintiffs in the case of Junior Sports Magazines Inc. et al., and Rob Bonta. The First and Second Amendments were big winners.  From the Court Order:

III. JUDICIAL DECLARATION 

IT IS HEREBY DECLARED that Section 22949.80, in its entirety, violates the First Amendment of the United States Constitution on its face and as applied to Plaintiffs.

IV. PERMANENT INJUNCTION

IT IS HEREBY ORDERED that Defendant shall be permanently enjoined from enforcing section 22949.80. The Attorney General is further directed to issue an alert through an information bulletin or other ordinary communications notifying all District Attorneys, County Counsels, and City Attorneys in California that enforcement of Section 22949.80 has been permanently enjoined in its entirety.

In addition, the Attorney General was ordered to pay the lawyers’ fees to the Firearms Policy Coalition (FPC) and the Second Amendment Foundation (SAF). Gavin Newsom, a proponent of this law, and the state of California will now pay the plaintiffs $1.38 million in fees.

What is amazing is the first judge thought this law was peachy keen. Gavin Newsom, of course, is not paying a cent.

It is all being paid for by California an US taxpayer dollars. It is easy to be reckless and stupid with other peoples money.

Such is the essence of government - spending other people's money. You don't have to work for it, so no incentive for good stewardship.

Like the Pigferd settlement, where there we like less than 500 minority owned farms. Suddenly you have tens of thousands claims years later. Some “thought about farming, but due to the rules, decided not to.
So can I say I thought about advertising, and file a claim that my constitutional rights were violated.

These gubmint officials should be held Personally Responsible for these deliberate attacks upon the “people”. Then and only then will these Direct Attacks on the US Constitution end.

Immunity protects stupid and evil people in government.
We need a different way of protecting good people from nuisance lawsuits.

The courts will soon be very busy with appeals of idiotic gun laws making their way through the Legislatures in Virginia and Minnesota. One Minnesota bill would have inspections, presumably by law enforcement, of places where the registered guns are stored to verify they are “ properly secured “…..violating not only the Second Amendment, but also the Fourth.

Must be part of the foolish “Trump Proofing” California that Newsom and Bonta did after Trump won the presidency:

“Gov. Gavin Newsom called a special legislative session aimed at ‘Trump-proofing’ California in anticipation of a second Trump administration, seeking to appropriate resources—potentially up to $100 million—to the California Department of Justice and Attorney General Rob Bonta’s office to file lawsuits.”

Neither Newsom nor Bonta have any clue what the Supremacy Clause means.

why should the taxpayers have to pay for this Californication snafu

anyone with even a grammar school government class could see that this Calif “law” was super-unconstitutional

let’s figure out how to make the legislators and governors accountable .... let them pay for their misconduct ... not the taxpayers (who got screwed by their initial “law” and now get screwed a second time being forced to pay for it)

making politicians accountable...some prison time would be very helpful too —let them work off the costs of their misconduct by working on a chain gang to patch up the highways and clear fire-prone brush
