It does seem that the process is the punishment. Under this kind of system the government can punish you for non-crimes even when they know there is no chance of conviction for breaking a law.

Let’s not forget the first part of the first Amendment. Freedom of religion. That’s trampled on often. Without it, the rest of the Amendments fall like dominoes.

Several years ago, I was a passenger in a plane heading for San Francisco. I had the window seat and the guy next to me noticed that I was reading a gun magazine and he said "I would never own a gun and nobody can make me own a gun"
I said, "fine, that's your right - but you do know that you benefit from guys like me that own them, practice with them, and keep them ready?"
He was incredulous and asked me how that worked.
I said "because at least 50% of the population are gun owners, anybody who thinks that your home can be entered and your family and possessions will belong to them has to think very carefully before breaking in. You benefit because we gun owners are ready behind our doors and they have to assume that you're one of us".

I recall an incredible story years ago where this guy from Florida (or Texas) had a concealed weapons permit and was traveling through Maryland. He had no weapons as he knew Maryland would not allow them. He was pulled over for a traffic violation and his concealed permit showed up when they ran his plates. He was detained on suspicion of having an illegal firearm and his car was literally taken apart piece by piece to try and find a gun.
I have a friend that lives in Maryland, I will never go there because of those communists.

Any time any gov't entity does something like this, where charges aren't brought, charges are dropped, or there is no guilty verdict, their department should, at absolute minimum, be responsible for 100% damages. Situations like this, where the arrest clearly shouldn't have happened in the first place, should warrant three or five or ten times damages.
The only exception to this is non-violent drunks who are dropped in the drunk tank and just released the next day.
