Insurance Companies Likely to Take Hard Stance on Non-Domiciled CDLs

A change in insurance policies could be coming to the trucking industry, signaling a major shift in their approach to non-domiciled commercial driver’s licenses (CDLs). As enforcement of the new non-domiciled CDL rule takes shape, insurance companies are likely to position themselves to avoid potential liability exposure.

According to an insurance executive at one of the largest brokers in the country, who spoke on condition of anonymity, he expects that insurance carriers are likely to implement policy changes that explicitly prevent the hiring of drivers with non-domiciled CDLs within the next year. The concern stems from the potential for “nuclear verdicts” in accident cases involving non-domiciled CDL holders, as juries may show little sympathy toward carriers employing drivers whose licenses may be invalid under the new regulations—especially after DOT Secretary Duffy has come out so strongly against the states that issue non-domiciled CDLs.

His words of warning when referring to carriers and brokers looking the other way on non-domiciled CDLs: “It’s all over.”

Potential Liability for Brokers

The implications extend beyond just the carriers themselves. The same insurance executive warned that freight brokerages utilizing motor carriers known to hire non-domiciled CDL holders could potentially face legal culpability. Plaintiffs’ attorneys may target brokers as well as carriers in lawsuits involving accidents with non-domiciled CDL drivers.

Several carriers have already reported increased scrutiny from their insurance providers.

One fleet executive commented that his insurance renewal was more stringent than prior periods, demanding:

Pictures of drivers’ licenses Verification that driver domiciles match their CDLs and business entity Clean MVRs (Motor Vehicle Records) Correct address information on payment documentation Signed statements confirming certain previously leased drivers would not be affiliated with the company

What's wrong with these insurance companies? Could get huge verdicts when driver falls asleep, makes uturn on interstate etc., and is illegal alien, working more than legal number of hours, etc.

How about the “No Name Given” on CDLs? That is such unbelievable nonsense. And those “No Name Given” are on REAL ID-compliant driver licenses, too!!

Seems like insurance companies are at huge risk insuring companies that accept that bogus ID.

Pictures of drivers’ licenses
Verification that driver domiciles match their CDLs and business entity
Clean MVRs (Motor Vehicle Records)
Correct address information on payment documentation
Signed statements confirming certain previously leased drivers would not be affiliated with the company?!

A non-domiciled Commercial Driver’s License (CDL) is issued to individuals who are not U.S. citizens or permanent residents but are authorized to work in the U.S. Recent regulations have tightened the requirements for obtaining these licenses due to safety concerns and improper issuance practices.

No kidding. The YEARS long hoopla about getting a REAL ID, how you won’t be able to to get on an airplane without it, etc. For YEARS we were harangued about the upcoming change.

Then some states issue a REAL ID compliant DL with “No Name Given”? Those states should have their authority to issue REAL ID revoked!

AG Bondi needs to get her people on this ASAP.

The insurance company can adopt these underwriting guidelines, but will some states (i.e. California) pass laws banning these guidelines or regulate these guidelines out of existence? For example, the state’s insurance commissioner tells the company, that is a nice company you have, I would hate to have it go through an expensive audit every year.

According to google: “A non-domiciled CDL is a Commercial Driver’s License issued by a U.S. state to someone whose permanent home is outside of that state or country.”

IOW, has nothing to do with citizen ship.

And the insurance company can determine that between increased exposure and compliance costs it's just not viable to continue to do business in that state.
