Here’s what some are missing: when you see those airport arrivals, do you ever see the child arrive alone or with only medical staff? No, they are accompanied by a retinue of other “Gazans” and I guarantee you that there are avid Hamas supporters if not operatives among them.

Holy Land Foundation Conviction
The Holy Land Foundation for Relief and Development (HLF) and five of its leaders were convicted on November 24, 2008, by a federal jury in Dallas on charges of providing material support to Hamas, a designated foreign terrorist organization.
The conviction followed a retrial that included approximately six weeks of testimony and seven days of deliberation, resulting in guilty verdicts on all 108 counts, including conspiracy to provide material support to a foreign terrorist organization, providing funds to a specially designated terrorist, and money laundering.

The five convicted individuals were HLF’s former CEO Shukri Abu-Baker, chairman Ghassan Elashi, Mufid Abdulqader, Abdulrahman Odeh, and Mohammad El-Mezain.
Two other defendants, Haitham Maghawri and Akram Mishal, were named in the indictment but were outside the United States and remain fugitives.

The U.S. government presented evidence that HLF, which was the largest Muslim charity in the United States before being shut down in December 2001, funneled approximately $12.4 million to Hamas through zakat committees and charitable societies in the West Bank and Gaza that were allegedly controlled by Hamas.
Prosecutors argued that the financial support, including aid to families of Hamas martyrs, detainees, and activists, was knowingly provided to strengthen Hamas’s infrastructure and encourage further terrorist activities.

Although the prosecution admitted that the funds went to local charities rather than directly to Hamas operations, and those committees were not on the U.S. terrorist list, the jury was convinced that supporting these Hamas-affiliated entities constituted material support under U.S. law, which recognizes the fungibility of money.

On February 5, 2009, U.S. District Judge Jorge A. Solis sentenced the defendants: Shukri Abu-Baker and Ghassan Elashi each received 65 years in prison, Mufid Abdulqader was sentenced to 20 years, and Mohammad El-Mezain and Abdulrahman Odeh each received 15 years.
The court also reaffirmed a $12.4 million money judgment against the defendants, except for El-Mezain, who was not convicted on money laundering charges.

The case, known as the largest terrorism financing prosecution in U.S. history, has drawn ongoing legal and public debate, with defense attorneys filing petitions for a new trial based on new evidence asserting the independence of the zakat committees.
