What does the gender of the LEO matter? Weren’t most of the LEOs on the Nicole Brown murder case males? I recall that they weren’t stellar at collecting evidence, but it never occured to me that it was their gender that made them botch their jobs.

Oh, so he is not being tried for his crime, which is on tape, but on whether the police carefully dotted the i’s and crossed the t’s in carrying out the investigation.

Agree. If the backpack is going to be placed into evidence, it has to be searched to inventory its contents. If it is going to be placed into his property at the jail, it has to be searched for the same reason. There is no illegal search issue here.

This is overly dramatic of a headline and story. “Luigi’s lawyers say...,” like what the hell do you think they’re going to say? Wait for a judge to actually rule something before flying into hysterics.

There’s a full manhunt on for a depraved violent killer who just killed a man by shooting him in the back. At some point you’d think public safety common sense in an emergency like this would take precedence over technicalities.

Plus the constitution protects individuals from “unreasonable” searches and seizures by the government...

can either side prove the search was unreasonable or reasonable ?

If a judge agrees, it could pose a major hurdle for the Manhattan district attorney.

Is the judge in New York or Pennsylvania? A Manhattan judge will surely agree that the search was without a warrant, illegal, and any evidence from the backpack not allowed in court.

Not so sure about Pennsylvania, where the backpack was searched - could go either way.

Disgusting that there is a fund raiser for this murderer who shot his victim in the back.

SOP when searching a suspect for a weapon: search everything on person. Perfectly legal.
