I think that the question is whether or not they had sufficient cause to arrest him without the evidence found in the backpack. I don't know enough of the facts to form an opinion about that. Just because he may have resembled someone who committed a crime in another state, that standing alone, without more, does not necessarily make a strong case for probable cause to arrest. If there was no probable cause to make an arrest, then there was no legal grounds upon to search his backpack, or to do an inventory search, as you suggest.
The search is legal. Subsequent to arrest he can be completely searched and everything inventoried. You can rifle through his pockets in minute detail, not just a weapons pat down. You can go through his backpack without a warrant to inventory everything subsequent to his arrest. If you find cocaine, a pistol, etc... you CAN charge him with it.
This is a defense lawyer shooting for the moon. Total bullshit. If he were arrested at home, no. But out in a McDonalds with a backpack.... totally legal and long settled all the way up to the supremes.
