This depends on the sequence. Was he already arrested on suspicion of murder before the bag was searched? Or was the bag searched first before he was arrested for suspicion of murder based on what was in the bag?

IIRC, the cops approached him at the table in McD’s and asked him if he was Luigi Mangione. They already had a warrant for his arrest in NYC. He replied in the affirmative and the rest is history. The lawyers can go jump in a lake...........

Mangione’s lawyers will grasp at anything in this pre-trial period.
Just because they claim the backpack needed to somehow be under warrant for a search - that does not mean the judge will even consider.
It seems like a very far-fetched demand, unlikely to be granted.

It is a non-issue. He was wanted in NYC, but was arrested at a McDonald’s in Altoona, Pennsylvania.
Whatever happened in Pennsylvania is irrelevant. They have video of him killing the man..............
Regrettably, there are a few here who appear to regard every female or minority hire to be a result of DEI.
So uh… if the gun was planted then he wasn’t the shooter so why make him a hero?
My memory of search and seizure is that the law may search whatever is within arm’s length that may be accessible to the detainee.. it is for the safety of the officer. This is true inside a car where you have the plain view excepyption, and the reasonable access exception.

Yes, like it or not, that is an attorney’s job.
Their job is to defend their client, and to do anything and everything to ensure the client’s rights are respected and force the government to prove its case, no matter how open and shut it is.
This case, is about as open and shut as you can get. However, lets just say the judge does toss the backpack search. That doesn’t equate to him being let off or charges dropped.
He’s on camera, killing the man... I doubt honestly the backpack evidence will get tossed, after all, they are arresting a suspect, who they suspect of murder, absolutely seems like that’s probably cause to search his belongings when you arrest them.
We shall see how this all plays out, I am not following this case closely at all, so maybe there are some extenuating circumstances my lack of familiarity doesn’t know about, but cops are on a manhunt for a killer, they have your name and identity. Seems to me when they arrest you, they have probable cause to search the backpack you are carrying at the time of your arrest.
This isn’t some random person just stopped by police, with no probable cause. They have every reason to believe you committed murder, cold blooded violent murder. If that doesn’t provide probable cause, I certainly am confused as to what would.
You have rights, certainly, but the standard is “without probable cause”... I am hard pressed how they can argue these police would not have had probable cause. And yes that probable cause could turn out to be inaccurate, but that doesn’t mean the police/(IE state) violated your rights.

Guys, settle down, he’s not getting off.
First of all, just because a defense attorney files a motion, doesn’t mean that the motion has any actual merit. Secondly, for the search to have been illegal would require lack of probable cause. I am hard pressed to believe police arresting a suspected murder lack probable cause to search their possessions at the time of arrest.
And finally, even if the judge were to uphold the search was illegal, the mans on video committing murder, with plenty of witnesses... the backpack and its contents are hardly the only evidence in this case... he’s not walking, at least not walking over this.
