Trust me Mr. Luttig, if Jack Smith could, he would have already, you see it's totally out of his hands. On Monday, The Supreme Court is going to rule on Trump's "presidential immunity" claim and it's a virtual certainty that they will set "some" presidential immunity standard (if they were just going to reject all presidential immunity outright, they would have done so weeks ago and not gone past their term end date to finish wrangling over a standard.

So once this happens the trial can start right? Nope! Then it goes back to the appeals court and the appeals court has to review all of Trump's immunity claims again under the newly established Supreme Court standard which will take weeks if not months.

So, say it's now September and the appeals court again rejects Trump's presidential immunity claims under the new standard. Now the trial starts, right? Nope! Trump can appeal to the Supreme Court again saying the appeals court misinterpreted the standard.

Let's say Jack Smith gets a lucky break this time and the Supreme Court declines the appeal. Now it's mid to late September. So, the trial HAS to start now, right? Well, we're getting closer, but now the defense can start filing pre-trial motions, there will be evidentiary hearings on what to allow and what to reject, and all this will take weeks or months before Jury selection is even slated to begin.

Long story short, a trial before the election isn't happening even under the best-case scenario for Jack Smith.

Perhaps he is already anticipating the very very sad (for liberals) news that the Supreme Court will be delivering on July 1 on the subject of Presidential immunity...

Article 3 says that the Justices serve "during good behavior," and Article I says that Congress "shall in all Cases, except Treason, Felony and Breach of the Peace, be privileged from Arrest during their Attendance at the Session of their respective Houses, and in going to and returning from the same; and for any Speech or Debate in either House, they shall not be questioned in any other Place."

It is only the President who has no protection for their behavior in the elected office?

Is "good behavior" for the Justices limited only to when they are on the bench hearing oral arguments or when they release their rulings, but at no other time?

Is "going to and returning from" Congress an official act of Congress or is it a secondary act that is still protected?

So why are enemies of President Trump arguing that the President has no immunities for himself, or that they are so limited in scope to be narrower than even the members of Congress and the Supreme Court enjoy?
