The Bush v. Gore case arose as an appeal from a decision of the Florida Supreme Court. The key to the Court’s ruling in favor of Bush was that the Florida Supreme Court had endorsed a count of votes in Palm Beach County alone, which violated the equal protection clause of the 14th Amendment. In contrast, a uniform statewide count would have passed constitutional muster.
