Robert Hur report and testimony is the biggest elephant in the room. The term "arbitrary enforcement" used frequently by both the defense and Judge Aileen Cannon.

Cannon hammered the fact no former president or vice president has been charged under Espionage Act for taking and keeping classified records including national defense information--which represents 32 counts against Trump in Jack Smith's indictment.

Prediction: Cannon won't dismiss the case based on the motions debated today--vagueness of Espionage Act and protection under the Presidential Records Act.

But it's very likely she will dismiss the case based on selective prosecution, a motion still pending before her.

I dearly hope that Judge Cannon has the courage to dismiss this nonsense. Thankfully the Hur report can be used by Cannon. The report documents the reckless ways Biden, without properly being cleared, took highly classified documents and stored them in several different locations where unauthorized people could have viewed them (and probably did!) And despite that, there have been no charges against Biden. It is, as the article stresses, the elephant in the room, and imo, a monstrous case of selective prosecution.

I would think that the highly enterprising Hunter would find this type of documents a valuable commodity for his business.

An investigation might roll up the older Bidens. It's possible that the Biden's have been dealing in top secret information as a sideline to the political racketeering.

The timeline clearly establishes a malicious prosecution and misleading the court:

a) Smith charges Trump with unlawful possession of classified docs beginning the day he left office, January 20, 2021;

b) Months later, the DOE pulls Trump's 'Q' clearance but backdates the removal to January 20;

c) there is no clearly stated legal requirement for a President to have a clearance, nor the procedure for acquiring one. Such a requirement would mean the bureaucrats have a legal right to withhold information from the President, which is absurd.

d) there is no history of any President or Vice President being charged regarding handling classified docs, despite the fact that all past Presidents are known to have retained oodles of classified docs

This also shows how important it is that the case is being tried in Florida and not DC, as the DC circuit and court of appeals are clearly tools of the Democrats after Obama expanded the size of that circuit. Almost like they were planning to indict their political opponents.

“Fox News just reported that judge will probably NOT dismiss the case.”

That’s not a report. It’s a prognostication.
