All 7 judges on the Colorado Supreme Court are Democrats appointed by Democrat governors with the case funded by a moneyed Democrat organization and prosecuted by a Democrat AG and its decision enforced by a Democrat Secretary of State. Yet, the decision was still 4 to 3. The 4 Democrat functionaries picking up a paycheck for their no heavy lifting job are what are known in legal and judicial circles as the sleaze factor. Those 4 should be subjected to a do not retain campaign next election season.

I just fought my way through the 200+ page PDF of the majority (unsigned) per curiam decision and the three dissents.

The four blind rats who ruled against President Trump were politically motivated, as their legal reasoning makes no sense. Colorado’s election code does not provide for a mechanism for state courts to determine whether a candidate has participated in an insurrection. Therefore, the state trial court (Judge Sarah Wallace) had no jurisdiction to rule either way on this issue. That seems also to fly in the face of numerous US Supreme Court decisions that issues under federal law are for federal courts to decide.

I think these Democrats must think they are never going to lose another election. They forget that their decisions are double-edged swords. Wherever GOP or conservative/originalist/textualist judges are in the majority, this decision, if it weren’t so laughable, would be the basis to strike Biden from the ballot.

All of that said, Trump and all down ballot GOP candidates in Colorado have got to get to the US Supreme Court either tomorrow or Thursday at the latest, to file two papers: the first, a petition for the issuance of a writ of certiorari, and second, a request for an immediate stay of the Colorado Supreme Court’s decision pending the outcome of the litigation in the US Supreme Court. The second paper goes to 10th Circuit Justice Gorsuch (he is the intake for such requests from Colorado), so hopefully justice will prevail.

The Colorado Supreme Court decision is so bad that it will help President Trump in the end.

I find it interesting that this was a 4-3 decision, all 7 State Justices having been appointed by a Democrat Governor. Thus even some Democrats can see how bad the ruling is. I wouldn’t be surprised if the US Supreme Court rules 7-2, and am sure they will likely give some ground somewhere to get one of the Dem’s to join the Republican appointed Justices.

It is actually a good thing to get this ruling now - as it can be expedited to the Supremes and hopefully get a decision early in the year to put this nonsense to bed.

This ruling won’t stand. But if it does, then you can be sure that the Republic is coming apart because they’ve destroyed the franchise and it’s the foundation that holds us together. Without that? It’s a whole different ball of wax.

Now all we need is for Republican Secretaries of State in critical swing states to ban Biden (or whoever the Rat nominee really is) from the ballot. That would have a big impact on the election, as opposed to bans being handed out in states which are foregone conclusions for good reason.

Just one problems: there aren’t any Republicans as SOS in key swing states. EVERY critical swing state — Arizona, Pennsylvania, Nevada, Wisconsin, Michigan, North Carolina — has a Democrat in that position. Important states which have Republicans in that office are already pretty safe for Trump (Ohio, Florida, HOPEFULLY Texas is safe).

Yes, the SOS in Georgia is allegedly a Republican. Who along with his Governor hates Trump even more than most Democrats do, so I doubt he’s going to be of much help.

The 4-3 vote is just for show, to make it look like there was actually some thoughtful consideration put into this pre-ordained result. All 7 are mouth-breathing Democrats, so I'm sure they are all on board with this vote.
