Trump didn’t incite anyone to do anything illegal or violent. He told people who where going to the rally at the capitol to stay peaceful. The crowd had been infiltrated by people who were not the normal Republicans that he got at his rallies. There was never any violence at his rallies and no reason to expect any. When was the last Republican rally that turned into a riot. The best excuse the capitol police and DC police for their botched crowd control was they didn’t expect Republicans to riot either.

The only evidence of someone inciting a riot was Ray Epps telling people to go into the capitol. They many have been other bad actors like him who had a plan to start a riot but most people were not expecting that. Trump authorized 10-20,000 national guard troops but the mayor of DC didn’t think they were needed,. They didn’t expect a group of Republicans to riot. They didn’t think they even needed to do standard crowd control. The bad actors came with a plan to cause trouble and they were dressed and equipped like Antifa. They had tools for smashing windows and helmets. They had their plans before Trump gave his speech. Most of them did not go to Trump’s speech.

According to this section of the US Code, President Trump's speech on January 6 does not meet the definition of incitement to riot. How can it then meet the definition of an insurrection?

In 18 U.S. Code Chapter 102 - RIOTS, specifically 18 U.S. Code § 2102 - Definitions, is this:

(b) As used in this chapter, the term “to incite a riot”, or “to organize, promote, encourage, participate in, or carry on a riot”, includes, but is not limited to, urging or instigating other persons to riot, but shall not be deemed to mean the mere oral or written (1) advocacy of ideas or (2) expression of belief, not involving advocacy of any act or acts of violence or assertion of the rightness of, or the right to commit, any such act or acts.
President Trump spoke of his belief that he won the election, and then asked the attendees to peacefully walk to the Capitol to show the lawmakers their support for President Trump. That meets the exception to the "to incite a riot" definition.

There. Was. No. Riot.

There were feds trying to act like normal American Citizens.

There was an-teetee-fah (gs) breaking windows.

There were capital “police” throwing grenades into a peaceful, lawfully assembled group of normal American Citizens protesting the most corrupt politician in the US being installed as President.

There were provocateurs yelling to “occupy the Capital.”

For once all the little progs body cameras recorded the crimes of the feds, te-tes, “police” and provocateurs.

The CCP progs in congress can try all the legal harassments of PDJT the like, they will be laughed at until they slither away.

There was no “Republican riot.”

If “republicans” riot against the CCP progs there will be no ambiguity and video will not be necessary.

Pervert Joe will be asking Jill which holiday the parade on TV is for.

He didn’t incite anything. It was a group where a few rowdy folks managed to get into the capitol building...It was the lack of LE that let it grow. I’m trying to find out why the police didn’t attempt to disperse the crowd BEFORE it got rowdy.

If, and I mean IF there really was an "insurrection" it was incited by the FBI.. And probably several other three letter organizations in the mix..

The outright MURDER of Ashli Babbitt may have been intentional in order to incite more violence from the crowd....

... does not include or apply to the President.

It only applies to the elector for the President. I think the only leeway would be if the President is an 'officer of the United States' The Volokh conspiracy discusses this in Volokh Officer of the United States

(2010), Chief Justice Roberts observed that "[t]he people do not vote for the 'Officers of the United States.'" Rather, "officers of the United States" are appointed exclusively pursuant to Article II, Section 2 procedures. It follows that the President, who is an elected official, is not an "officer of the United States."

So how are they even charging President Trump?
