He was the chief of the Capitol Police. Everything his officers did on that day is on him.
He had to have given the orders or so poorly trained his officers that they were willing to attack and kill unarmed protestors. Since they never did it before in all the years that people have been freely protesting in the Capitol something changed under his watch.
And yes, if you are given an unlawful order you are suppose to not follow it.
