Pence was working up the crowd in the days Prior. “We’re going to hear the Evidence” doesn’t sound like simply signing off, as he contends was his only option.
Pence should be charged, if Trump’s Protest Peacefully is a Crime.

Either I am missing the point or you are missing the lawyer’s point. Smith’s indictment allows his attorneys to provide evidence as to why Trump legitimately believed the election was a fraud. They not you or I will, for the first time, present evidence that Trump was correct in believing the election was fixed. They will further claim he had a first Amendment right to act and speak as he did. I have heard already some back tracking on whether Trump will actual end up on trial. If he does it sounds to me like his lawyers plan to have a massive witness list from every corrupt jurisdiction in the country.
While you remain focused on 2024, his lawyers will fight over fraud in 2020, that’s their job.

The call litigate the 2020 election is exactly the right approach in a criminal case where the defendant is accused of malfeasance related to the 2020 election.
If Trump is charged with a murder that took place in 2020, are you suggesting his lawyers shouldn’t try to prove that the alleged victim was killed by someone else — or may even still be alive?

I think that what Lauro is saying that in order for President Trump to present a defense that he actually believed that he won the election and it was stolen from him (his 1st amendment right to speak out), then they have to show the evidence of WHY Trump believed what he did.
They have to show the reports of:
- states stopping counting simultaneously;
- the "burst pipe" in Fulton County that enabled the counters to send observers home;
- the suitcases of ballots being pulled out from under tables;
- the simultaneous jump in Biden votes in the middle of the night in multiple states;
- the nearly 90% turnout in Wisconsin
- the lack of signature verification in Pennsylvania;
- the sudden changing of deadlines to receive absentee ballots by some judges in Pennsylvania and elsewhere;
- the lack of matching absentee ballot requests that match to absentee ballots that were counted;
- and on and on and on...
All of these things would add up to a general belief that, state by state, coordinated shenanigans were in place to tilt the vote just enough to cause the state to go for Biden.
The defense will have to "relitigate" these things in order to present a pattern of facts that led President Trump to the good-faith conclusion that he reached, and that his speaking out against it was protected speech and a petition to the government for a redress of grievances.
