That Was Quick: Appeals Court Blocks Injunction Prohibiting Big Tech-Gov't Censorship Collusion

The U.S. Court of Appeals for the Fifth Circuit apparently decided that the federal government maintaining its Orwellian censorship collusion with Big Tech was more important than protecting Americans’ free speech.

Louisiana Chief District Judge Terry A. Doughty issued a preliminary July 4 injunction prohibiting President Joe Biden’s administration from “engag[ing] in any communication of any kind” with Big Tech platforms for the purpose of pushing censorship of constitutionally protected speech. That ruling had a shelf life of about 10 days. After Doughty initially denied the Biden administration's request for a stay on the injunction on July 10, the Fifth Circuit decided to step in for the president just four days later. The Court granted the DOJ a “temporary administrative stay” on Doughty’s injunction “until further orders of the court.” Free speech be damned.

The feds already are inside and staffing big tech as inside assets. Kinda hard to prevent them from communicating unless they are all walked out.

They should be walked out.

All of them.

The federal government has a constitutional duty to protect free speech and privacy. NOT limit free speech and violate privacy. This is all backwards.

A TAS is intended to give the appellate court time to consider the arguments. Let us hope they consider them quickly and on merits.

They could have considered the arguments with the injunction in place. I haven’t and don’t intend to read their TAS but curious what harm the 5th agreed would occur.

The temporary order should go in the direction that causes the least harm while the court considers the case. For example, if I am shooting randomly down the street the court would order me to stop because I could kill someone while it considers the case. In this case the court ruled that silencing the American citizenry is less harmful than allowing them to speak. What a bunch of tyrants in black robes.

Agreed it should to to least harm. There will be accelerated oral arguments and the stay considered at that time. Appears that 5C was trying to split the baby.
