Biden DOJ Moves to Jail Trump Before Election, Sets Trial for Aug 14, 2023

Joe Biden and his DOJ are attempting to jail President Trump just before the 2024 Presidential Election in 2024

Tuesday morning it was announced that 45th President Donald Trump’s trial is set to begin on August 14th, 2023, leading many to believe that the Biden DOJ is attempting to jail their political opponent ahead of the 2024 election. Trump’s legal team says they will attempt to push back the trial date.

United States court documents released on Tuesday state that President Trump’s case must start on August 14th, 2023, or soon after. The document reads, “This case is hereby set for a Criminal Jury Trial during the two-week period commencing August 14, 2023, or as soon thereafter as the case may be called. A Calendar Call will be held at 1:45 p.m. on August 8, 2023. All hearings will be held at Alto Lee Adams, Sr. United States Courthouse, 101 South U.S. Highway 1, Courtroom 4008, Fort Pierce, Florida 34950.”

Documents also show that all pretrial motions must be submitted to the court by July 24th, 2023. Trump’s legal team is expected to submit a request asking for a delay in the trial start date before July 24th, 2023.

During his remarks following Trump’s indictment, Jack Smith said he wants Trump’s trial to start as soon as possible.

As polling shows Donald Trump beating Joe Biden in the 2024 election, many took Smith’s announcement as Biden’s DOJ attempt to lock up Joe Biden’s political opponent before voters go to the polls.

National File previously reported that Federal Magistrate Judge Bruce Reinhart granted Joe Biden’s DOJ request to place a gag order on President Trump. Trump can no longer post about his case on social media without the court’s permission.

The case against President Trump coincides with Hunter Biden taking a sweetheart deal with DOJ prosecutors to avoid a felony conviction on a federal gun charge and to avoid jail time on charges of willfully not paying his taxes.

Assuming there is no way to have the case dismissed before trial, I am unsure what the best date is. My daughter and her lawyer boyfriend were over on Father’s Day. He pointed out that the trial is going to look a lot different than the way the media is presently talking. Trump’s team will have motion after motion, some of which will to be to suppress illegally gained and manipulated so-called evidence.

The political side of me thinks a long trial at the beginning of primary season helps Trump. Hopefully, Trump is indicted monthly until November next year. His poll numbers get better with each indictment.

It’s not Biden. It’s his handlers. Biden may not even be aware, or remember, that Trump is on trial.

His attorneys don’t even have security clearances yet.

This leaves virtually no time to depose witnesses and get discovery.

This trial won’t happen until after the November 2024 election.

You are right but that is going to upset the NeverTrumpers and some RDS supporters on FR.

They are trying very hard to back up the DOJ and Merrick Garland.

Is Aileen Cannon, the Trump appointed and sympathetic to Trump judge who set the trial date, part of the Biden DOJ? If she was even mentioned in the article I missed it.

(CAPS emphasis mine)

“(1)IN ANY CASE IN WHICH A PLEA OF NOT GUILTY IS ENTERED, THE TRIAL OF A DEFENDANT charged in an information or indictment with the commission of an offense SHALL COMMENCE WITHIN SEVENTY DAYS FROM THE FILING DATE (and making public) of the information or indictment, or from the date the defendant has appeared before a judicial officer of the court in which such charge is pending, whichever date last occurs. If a defendant consents in writing to be tried before a magistrate judge on a complaint, the trial shall commence within seventy days from the date of such consent.”

Statute recognizes that there may be some delays that the court will recognize.

For all the armchair judge’s and lawyers who don’t know jack-ship about the law and criminal procedure: Under the Speedy Trial Act of 1974, as amended, the court must set a trial date that is no more than 70 days from the date of arraignment. Once set, the dates are routinely pushed back to accommodate pre-trial motions as well as requests for continuances, which are not included in the 70-day period. This is routine, standard operating procedure under Federal Law and the Federal Rules of Criminal Procedure.

Trump was arraigned on June 13th. The trial date is set for August 14th to comply with the Speedy Trial Act. It will get pushed back if, for example, Trump makes a pre-trial motion to dismiss the indictment or to exclude evidence, or if he asks the court for a continuance for more time to prepare.

With that said, there could be strategical reasons for Trump to keep the August 14th trial date.
