Garland does have to have a strong case to move forward against Trump. He only has to have confidence that his actions will be immune from any consequences. His job is to smear Trump, it is not about getting a conviction, or getting a criminal off the street. This is a fully political act and analysis that frames this is a legal case is meaningless.
