Any clerk is a possibility. I went to college with a fellow who wound up clerking for both Brennan and Souter. Just because someone would take a prestigious assignment with Roberts or Gorsuch, doesn’t mean he’s any more conservative than a typical National Review writer.

There are strategic incentives to leak on both sides of the argument. But obviously passions run hot so somebody may have acted without fully considering the long term impact on the court. I think the best evidence for a pro-life leaker is that April 26 WSJ editorial which is so prescient it makes me think they had the same intel if not the draft itself in hand when they wrote it. But it’s more likely a liberal clerk burn it all down mindset. Deutsch, the Breyer clerk looks like the prime the suspect. Working for Breyer so one foot out the door already. Long history of activism on the issue. Married to a WaPo journalist show shared byline with the Politico reporter, who also just happened to attend their wedding. Ummm ok. I want to know if other media orgs had the draft and hesitated to publish. If it was only Politico that really points toward those connected clerks. Also, why has nobody in the media straight up asked them if they did it?

Actually, while I think I have a good idea, this would be a terrible thing to do if someone was innocent and had their name out there. It would ruin their career. Wait for certainty.

I have no idea because I am ill informed of how the supreme court clerks run the office management. But I can tell you this I sense one Supreme Court justice is getting COLD feet right now. Come June you will see a vote of 5 to 4 to keep the killing babies 👶 in place...just a gut feeling. The pressure applied on them will be astronomical! Hope they have bodyguards 24/7 at work, home and around family members.

There are approximately 250 SCOTUS employees, including administrative and clerical people. If draft decisions and related materials can be accessed by admin and clerical individuals, that expands the universe of possible leakers to greater than 45 although none of us outside the court can know the exact number.

We also don't know the procedures under which those materials are kept. Are they highly secured both in paper form and electronically? Or is security around them relatively lax because...well, because of attitudes like "it's the Supreme Court and who would do such a thing."

Someone who didn’t want the GOP primary to be over before a Supreme Court ruling completely upends the general election and wipes out anyone who supports a closed border, reshoring, and in general MAGA (because as we all know the smart people in DC that aided technology transfers to China etc, can’t be having THAT!)

Whoever this leaker was, they gave the MAGA agenda a fighting chance.

No, any underling of the wise latina is going to WANT the GOP to be stuck with the maximum number of no-exception 6 week abortion candidates when they roll into the general election, because the way this was set up, MAGA was supposed to die in massive losses in an election the GOP was supposed to win overwhelmingly.

Not if it turned out to be a clerk for one of these progressive justices. They would fete that person as a hero-and he’d probably be hired immediately by the ACLU.
