My cousins and I had this figured out when we were kids. Once in a while down on Grandma’s farm, one of the dogs would have pups. We would go to the barn, pick up the pups, turn them over, and proclaim them either a boy or a girl. That works for humans too.

Judge Ketanji Brown Jackson “overlooks” (politically ignores?) that the Supreme Court established precedent with respect to recognizing biological differences between men and women when it decided Minor v. Happersett against Virginia Minor concerning women's suffrage.
Note that Minor's efforts ultimately led to the ratification of the 19th Amendment.
"19th Amendment:The right of citizens of the United States to vote shall not be denied or abridged by the United States or by any State on account of sex.
Congress shall have power to enforce this article by appropriate legislation."

I was under the impression that in today’s woke world gender is determined by the individual and can be changed by that individual at any point in time. Under this construct gender is determined by emotion, not biology.
“She was nominated for only two reasons. she’s a woman and she’s black. And she doesn’t know what a woman is. Can she define what a black person is?”
