No such power exists for the Vice President, nor does any such mechanism exist in the Constitution nor by statute for sending Electors back to the states that already turned them in. No one who keeps saying this can point to the section of the Constitution where this power or mechanism is because it doesn't exist. Once the several states submit their Electors, that is it for them. Congress can then reject the Electors - resulting in them not being counted, not "sent back."
That is simple reality. Even if theoretically the Vice President could make such a declaration during the Joint Session, a member could merely say make a motion to appeal the ruling of the Chair, and that would be the end of that in very short order.
Disagree. If there were no such power, the Constitution would not have specified a particular office to oversee it. It would have said something like "The Congress".
The fact that it specifies that office means that person has discretionary authority.
Even were that not true, the Vice President could have told everyone to "go f*** themselves" before agreeing to participate in that corrupt and fraudulent transfer of power.
Pence did what a gutless coward would have done, which was to lend an air of legitimacy to a farce.
Don’t you remember back in 2000 when then Vice President Gore rejected the Florida electoral Slate thus becoming our 43rd President? ;-)
The Supremes would have torpedoed a move by Pence in a heartbeat.
This discussion is moot.......
