A "rule", nope, that's why it was unconstitutional. And by now, with omicron waning, it's over. their massive power grab is finally coming to a forced end.
The courts reasoning has nothing to do with the rule being an ETS. It had more to do with OSHA not having the authority it was claiming.
A permanent rule also takes years to implement.

Yet another reason the entire Administrative State should be flushed, the Administrative Procedures Act repealed, and the Congress told yet again that it has no right to delegate its authority.
They can vote on every damn piece of legislation that controls our lives and then defend it when they come home to get re-elected.

The battle for the hearts and minds of the voters has been lost over mandates. People can be easily lead up to a point. We have passed that point and things are starting to change.
Just watch as people are less and less enthusiastic about Covid mandates. Watch as all levels of society start to say that Covid is ending, or that the numbers will be so low in a few months. The elite left know that they are a political loosing streak. Their only political solution is to declare victory, hope things return to normal and during the November election hope that people will have forgotten the hell hole they lead this country down.
