He was a stellar soldier Marine for about 18 years....

Never refer to a Marine as a soldier. It's considered a slur and an insult. The Marine Corps has Marines. The army has soldiers. So endeth the lesson. Semper Fi.

A Special Court Martial is not a Captain’s Mast/NJP/Office Hours. It is an actual Article 32 court-martial.

That’s funny. I presided over three as a Major, all by my lonesome.

Indeed, some specials have a panel as you state, and counsel is allowed.

Max of 1 year ( misdemeanor) confinement, forfeiture of three months pay if I recall and possibly a BCD.

He resigned his commission and the command refused it. They had an official gag order on him. He was under investigation for his remarks and it was progressing and he was ordered to stand down and he took to social media at his 1st opportunity. So they arrested him and threw him in the brig.

That's one of those things that leads me to discount anything else that person may say about military culture, etc.. If you aren't familiar with the basic distinction between "soldier" and "Marine", then you lack the requisite background knowledge to have an informed opinion about the rest of it.

Retired officers speaking out has always been treated differently. Active duty...Vindemann was a weasel who knew how to take advantage of a claim of whistleblowing, and did it under the shield of passing info to Congress. Scheller, in contrast, just charged straight into that machine gun without getting any cover or concealment. Didn't give any help to those who might otherwise have tried to defend him.

You just can't say the stuff he said repeatedly, and in uniform. There were other ways that he might have been able to get away with it -- he just chose the worst.

I feel for the guy but truthfully he would have been smarter to resign then unload on high command. He could be on the talk show circuit instead of rotting in the brig.

The contrast here is too great. A slap on the wrist and keeping his pay/benefits and retirement, or spending many years in Fort Leavenworth, a DD and poverty.

I am reminded of Eddie Slovik. A deserter, he was chosen almost at random for execution, because at that point the Army morale was poor in the face of a German attack. So he was going to be executed to raise moral.

But then the Malmedy Massacre happened. They no longer needed to execute him, so were very honest and said to him:

“If you say you were lost and separated from your unit, you will be forgiven and sent back to your unit. But if you insist that you deserted and would do so again if given the chance, you will be executed.”

“But I wasn’t lost, I wanted to desert! And I would do it again!”, insisted Slovik.

Thus, having no other choice, they executed the dumbass.

There are some people who will always insist on it, for what they think is their “honor”, or politics, or religion. I knew a Marine who always thought honesty was such an absolute that he would take a bullet for dumb reasons.

I asked him what he would say if his gf/wife asked him if she was getting fat. Sure, I’d tell her that she looked like a sack of blubber, he said.

“Ashes to ashes, and dust to dust, son”, I replied.

You are not allowed to be political in a uniform. He did so many times.

He was told to stop. He did not.

And yes, he was right. But if you have ever worked in a big organization, call out the bosses failures in public is a sure way to end your career and face consequences.
