If the chain of custody is broken or uncertain, the evidense is ruled inadmissible. The defense does not have to prove that something dodgy actually happened to the evidence.
So same principle applies here. If the rules were broken and dodgy stuff could have happened as a result, toss the results.
Logic would dictate that the burden of proof that the election was fair and the reported results accurate would rest with the Secretary of State, since she certified the election results. It certainly should not rest with those who are auditing the ballots and the process. So, as Senator Rogers says, all that they should have to demonstrate is that there is significant evidence that the reported results are questionable. It is Katie Hobbs’ responsibility to prove them wrong.

So she is expecting other states to initiate their own audit process only after the AZ report is issued ? If all they are waiting on are the canvass reports, maybe put out an interim set of findings that are basically complete now.

I listened to lawyer Robert Barnes on Viva and Barns podcast. He seems to have his act together on the lawsuits and recounts. He said that even if the results of the election are decertified, that once someone is in office the Supreme Court will not intervene. The reason is the courts have held that at some point, an election is a done deal. That point is when the results are certified. The court has never taken a case once the results are certified because, at some point, there has to be a “done deal.” Otherwise, every election would be challenged for ever. Also, this sort of lawsuit, audit, new findings have been going on for decades; not just for this most recent election.

Well, Wendy is wrong. You have to have evidence. It is important to understand what CyberNinjas have provided so far in testimony:
*Allegations and assertions that they found 74,000 more returned ballots than sent
*a host of irregularities regarding the sharpies
*other issues with absentee ballots-—all just in Maricopa County.
What they have not yet provided is the proof to the Senate. I am getting concerned that they won’t be able to have that proof without the keys & routers, which clearly MCBOS is NOT going to give them, and the Senate can subpoena all they want but no one is forcing MDBOS to play ball.
