CDC issues eviction moratorium extension after Democratic outcry

The Centers for Disease Control and Prevention (CDC) on Tuesday issued a moratorium on evictions targeting areas of the country with high levels of COVID-19 transmission, extending an eviction ban for much of the nation just days after a blanket moratorium had expired.

The CDC order applies to counties experiencing significant levels of virus spread, which is defined by the agency as 50 to 100 cases per 100,000 people. A congressional source said the order will likely apply to roughly 90 percent of the renter population in the U.S.

The order will expire on Oct. 3. It was issued after days of back-and-forth between the White House and congressional Democrats over who was responsible for extending the moratorium

There is rent assistance with the RAFT program. The government will pay mega bucks in back rent directly to the landlord. Tons of raft money left but there is a difference between not being able to pay rent and not paying rent because you don’t have to.

The CDC should just double the rent of anyone who isn’t vaccinated, since they have the authority to do this.

The longer this eviction thing goes on, the more eventful the resolution will be. Eventually lenders will be making noise about landlord defaults on mortgages. Betting on state agencies to distribute funds from the COVID relief lollapalooza funds is unrealistic.

On the other hand, this may just be a cry for help. "Stop me because I can't control myself." Maybe the dems are just waiting for the Supreme Court to govern in Congress's absence.

Congress ceded its powers and authority to the “administrative branch” of the federal government many years ago.

SCOTUS supposedly let the original CDC eviction ban stand even though they said it was illegal (!!) because it was due to expire in a few weeks.

Now what? The CDC ban is back. Will SCOTUS let the new ban remain? If they do, then it diminishes the power of what the court says. In effect they become not a final arbiter, but simply a court of suggestion. The real power would then move to agencies, like the CDC, that are run by the unelected an unaccountable.

I suppose the only way they could do it directly at this point would be to hold them in contempt. It would take another lawsuit seeking criminal charges to do anymore than that.
