Rafensperger justifies his actions by pointing at the consent decree he signed with the U.S. DOJ which dictated that Rafensperger allow vote fraud. The United States Constitution doesn’t place authority over presidential election procedures with the DOJ or with Rafensperger. It places that authority with state legislatures. The consent decree which Rafensperger followed broke state law, and therefore was unconstitutional.

That’s what the pre-Civil War Constitution did, subject to the “times, places and manner” clause of Article I Section 4.
