Not reading all this but I think some are looking at the audit and wanting to look for ways to look like they are doing a audit but not find anything.

Considering that HR1/S1 was stalled by the filibuster wall . . .

Check out this part:

<>The action in Washington now shifts to the bill known as H.R. 4—the John Lewis Voting Rights Act. “The truth is that H.R. 4 goes far beyond any civil rights law enacted during the height of the civil rights era,” [Judicial Watch Senior Attorney T. Russell] Nobile told Congress. “Rather, it is part of a grander plan to shift control of American elections away from individual state legislatures and into the hands of a single federal bureaucratic department.

<>The new provision grants the attorney general authority to intervene in “any act prohibited by the 14th or 15th Amendment” of the Constitution. Nobile warns that the “little-noticed provision will abolish a long-standing legal principle.” For more than 200 years, Congress and the courts have declined to give the attorney general authority to bring such cases.<>

The violated principle(s) are within the 14-15th Amendments. Both empower CONGRESS, not the executive or judiciary for their enforcement.

TL/DR

This discussion reminds me of the childhood question that would pop up whenever Trixie, our neighbor’s Boxer dog, would decide to chase a car passing through the neighborhood: What happens if she actually manages to catch the car?

Joe Biden is President because of the Congressional action on 6 January 2021 of receiving and accepting and compiling the certified election results from the individual Secretaries of State of the states and territories of the United States.

Let’s say, for hypothetical purposes, that the Arizona Senate-directed audit shows clear and convincing evidence of massive fraud on the part of election officials.

How does the finding effect the previous certification? Does the AZSecState act on the findings of an audit unasked for and that has been strongly criticized? Or is another audit conducted to determine the accuracy of the findings of the first audit? Assuming a positive result, does the AZSecState take the initiative to cancel the prior certification and issue a new one? Or is legislation or a lawsuit required to get action?

Assuming a new certification is issued reporting that Donald Trump won AZ in the 2020 election, will the US House of Representatives accept it? If it is accepted, does it change the outcome of the election? Etc, etc.

Repeat for possibly 19 other states; all on a slightly different schedule for getting through the wickets.

Then there is the process of actually removing the now “decertified” president. The only constitutional tools available for removal are impeachment and for incapacity. Putting the best spin on the process and assuming the House would actually proceed, being decertified is not exactly a “high crime or misdemeanor” and he may still be functional “enough” when the very carefully chosen members of select committee (already formed) examine him.

BTW Harris succeeding him changes nothing since they are tied together as a team and the certification/decertification covers them both. He leaves, she leaves. The only reason Harris is Vice President is because she was Biden’s running mate.

The office is assumed in the order of presidential succession until the 2020 winner is propérly certified and sworn in.

How long do you think Acting President Pelosi would serve?

What’s the timeline for all this to happen?

August 2021 seems wildly optimistic.

2022? Well...maybe concentrate on winning back Congress.

2023? That’s over half the term gone. Assume office now and he might not be able to stand for a full term in 2024.

2024? Nope. Running for president again.

The best alternative idea I have read is for DJT to run in 2022 for a Florida House seat on the expectation of the GOP regaining control. Displace Nancy and maybe become Speaker himself. Assuming all that happened, it would be a lot of work and a very steep learning curve.

Not sure DJT would like that now at his age. On the other hand, Congress is the probably the dealmaker’s equivalent of an opium den ...
