Jurors in Derek Chauvin trial face a Hobson's choice

A Hobson's Choice is defined as "an apparently free choice when there is no real alternative"

You will remember that Derek Chauvin was the Minneapolis cop who was charged for the murder of George Floyd. The Hennepin County Da has taken the shotgun approach to the case, charging Chauvin with every conceivably connected crime that could be mustered in the hope that something sticks. Recently a third degree murder charge, which has been dropped, was reinstated. This indicates that the DA is not terribly confident in the case. There would be good reason for that.

"I can't breathe" became the mantra for Floyd protests which resulted in a great amount of damage. It's good to review some facts. If you watch the police body cam video you will note that Floyd first begins claiming "I can't breathe" as the officers were trying to put him into the cruiser (1:38 of the video). He repeats it soon after- prior to being pinned down on the ground. Floyd was combative for most of the time.

Politics took over from science very early in this case.

Two different autopsies were performed and they differed.

Michael Baden, the former Chief Medical Examiner for the city of New York, gave the Floyd family exactly what they wanted:

A statement from the Floyd's family attorney read: "Sustained pressure on the right side of Mr Floyd's carotid artery impeded blood flow to the brain, and weight on his back impeded his ability to breathe.

"The independent examiners found that weight on the back, handcuffs, and positioning were contributory factors because they impaired the ability of Mr. Floyd's diaphragm to function."

But then adds this
Baden added that there were no underlying health problems, despite the official autopsy claiming a heart problem likely contributed to his death.

The former New York City chief medical examiner said: "He was in good health. The cause of death is asphyxia compression of the neck and back.

Good health? Hardly

Several of Floyd’s key heart arteries were severely narrowed – evidence of serious heart disease. Several were 75% blocked and one was 90% blocked, and that was made worse by where the clogs occurred in terms of crimping the supply of blood to his heart, Nelson said. Blockages of 70% or more usually cause chest pain, he added.

“That degree of narrowing is sufficient to cause death,” Davis said.

Floyd also had an enlarged heart — “48% bigger than it ought to be” — likely from his high blood pressure and heart disease, Nelson said.

“A heart that’s enlarged like this is more likely to develop an abnormal heart rhythm,” Davis added.

The autopsy also found signs of tobacco use. Smoking is a big risk factor for heart disease and many other health problems.

No underlying health issues? That's patently false. This is from the original Hennepin County autopsy
II. Natural diseases A. Arteriosclerotic heart disease, multifocal, severe B. Hypertensive heart disease 1. Cardiomegaly (540 g) with mild biventricular dilatation 2. Clinical history of hypertension  (emphasis mine)
This is also from the original autopsy
III. No life-threatening injuries identified A. No facial, oral mucosal, or conjunctival petechiae B. No injuries of anterior muscles of neck or laryngeal structures C. No scalp soft tissue, skull, or brain injuries D. No chest wall soft tissue injuries, rib fractures (other than a single rib fracture from CPR), vertebral column injuries, or visceral injuries E. Incision and subcutaneous dissection of posterior and lateral neck, shoulders, back, flanks, and buttocks negative for occult trauma
No neck or throat injuries.

Floyd had a fatal level of Fentanyl in his system.

"If he were found dead at home alone and no other apparent causes, this could be acceptable to call an OD. Deaths have been certified with levels of 3," Baker told investigators.

In another new document, Baker said, "That is a fatal level of fentanyl under normal circumstances."

He was already a dead man by the time he was removed from his car.

Baden's report was sought when the first autopsy didn't offer them the condemnation demanded by politics. There is another issue.

Family settled out of court today for $27 million bucks one of the largest settlements for a wrongful death suit.

Kangaroo courts are not serious proceeding by their very nature. That’s what this trial is, let’s face it.

Will the trial be like the trial of the men accused in the Boston Massacre (who were defended by John Adams) or like the fictitious trial in To Kill a Mockingbird (where the jury found an innocent man guilty to please the majority of their fellow townspeople)?

There are similarities to the Salem Witch trials. Hysterical accusations made before the evidence was fully known and facts shared by the media were cherry-picked to make the police look like racist pigs when actually following procedures. $3 billion in damage and 30 lives were lost based on the media narrative.

The state is trying to have the jury believe they can only find one of the three “murder/homicide” verdicts.

The two facts that will hang the jury are the drug levels in his system and the fact that the knee to the back was a taught method in Minneapolis.

Those facts present “reasonable doubt.” This presents another option for jurors.

This jury will hang every time the case is tried.

Baden’s opinion can be highly suspect depending on the “circumstances.”

This is a reasonable doubt trial. Assessed objectively, there is no rational jury which could fail to have a reasonable doubt on any of the charges.

But the jury will have a number of radical leftists probably, based on the venue, and they are skilled in overcoming reasonable people with manipulation and intimidation.

The best Chauvin can hope for is a single, courageous and objective juror. They do exist.

There is a very real chance that Chauvin will be tried multiple times.

I’ve had a 90%+ artery clogging for my first heart attack. After a while it hurts like hell, your body’s way of saying get your sorry butt to the hospital ASAP.

It doesn’t clog up overnight so Floyd did have an underlying condition that contributed to his death. Baden is a fool or incompetent, or both.

My next clogging killed me, for a few minutes re cardiac arrest. No hints of anything wrong, even with routine health checkups. The clogging might have slipped in between visits (every 6 months and didn’t have a monitor implanted back then. Do now.

Office Chauvin should be charged with 3rd Degree Negligent Homicide and “Dereliction of Duty, and sent to jail. He is not fit to be a cop. My son was a federal police officer and K9 handler for years. He was a good police officer with common sense and had to disarm mentally ill people.

He did not shoot them though he had the highest authorization to do so. His team knew how to handle the wackos who walked the streets of DC (politicians are in a different category of Crazy).

The Floyd family just got a settlement of about $27 million dollars. Their ambulance-chasing, whitey hating lawyer Benjamin Crump, in now set for life (It should be a life sentence for his unprofessional conduct, hate-filled rants and accusations, and for being the poster guy for racial hatred and cop-hating).

The key loser in all this was George Floyd and his family for loss of a father/husband (despite his behavior). The biggest loser was the city of Minneapolis which was run by idiots, incompetents and cowards, as well as their business-people who lost everything).

LOL ... published my take a few seconds after you. We say essentially the same thing.

Where we might differ is in the expectation that a juror or some jurors will be courageous and objective. I have my doubts about that, especially with the rioting and chaos which will happen.

I don’t think 27 million was enough. Minneapolis should have been hit for 100 million or more just because they are so stupid.

Assuming that their identities can't be held secret (a *very* reasonable assumption) there's no way that jurors will vote “not guilty” on a single charge. They know what would happen to them...and their families...if they did.

Baden is the epitome of “Expertise For Hire”. If I were ever a juror in a case that featured dueling pathologists...or dueling psychiatrists...there's no way that I'd believe the one working for the defense.In fact I may disbelieve *both* experts...but at the least I'd reject the testimony of the defense witness.

$27 million settlement can’t be justified. I have a business degree but had several law classes so I am giving my non professional opinion. BUT somewhere I learned that damage suits for loss-of-life have to be based on two factors. One is the earnings that the decedent would have earned and the family members support that will be required to keep the family in an equal economic status. Two is that there is a penalty that the party must pay for negligence that caused the death.

This is one huge settlement and wonder how it can be justified.

I would like to think that, but I am concerned the jury will be worried about their own safety. You can bet their identities are already being circulated.

When you put it that way I do have to agree. There has been $3 billion in property damage in cities all over the US due to the mostly peaceful riots last summer. Maybe Minneapolis should fit the bill for all of that too.

Minneapolis is a “Red” city and not a political color re voting.

Two, their mayor and city council are far-left ideologues so surrendering to their allies is easy.

Three. It’s the taxpayers’ money. No skin off their backs. They will still get kickbacks, under the table payoffs, “”pay to play” Benjamins, Soros/Bloomturd money, etc.

Fourth: They don’t give a damn!

You are absolutely correct. There is a component of reparations here. There is also the fear of a jury verdict going much higher. It is strategic and like sports salaries will inflate the market and expectations in future such cases.
