I believe VP Pence will then decide which electors to choose to count.

Trial in the Senate?

SCOTUS appeal?

Anyone know the process?

SOS chooses electors and confirmed by Governor. An alternate slate can be put forth by the legislature. Havent heard anything about the legislatures doing anything.

Sure thing. If the alternative electors vote for Trump in every state that was allegedly won by Biden and then we count their votes along with the Trump state votes, Trump will win unanimously.

I believe VP Pence will then decide which electors to choose to count.

No, the House and the Senate meet separately to debate and vote on which slate of Electors to count.

3 U.S. Code ยง 15 - Counting electoral votes in Congress

... and in such case of more than one return or paper purporting to be a return from a State, ... then those votes, and those only, shall be counted which the two Houses shall concurrently decide were cast by lawful electors appointed in accordance with the laws of the State, unless the two Houses, acting separately, shall concurrently decide such votes not to be the lawful votes of the legally appointed electors of such State. But if the two Houses shall disagree in respect of the counting of such votes, then, and in that case, the votes of the electors whose appointment shall have been certified by the executive of the State, under the seal thereof, shall be counted.

The House and the Senate vote separately on which slate of Electors to accept. If they do not agree, then the slate of Electors certified by the Governor of the State shall be counted.

Pence’s crayon has never colored outside the establishment lines and it isn’t likely to start now.

Wouldn’t it be a hoot?

At the meeting today the Electors hand the ballots to VP Pence for counting and he orders that the room be emptied. Once empty he brings in a shredder and after he makes marks on a legal pad, he shreds the original ballots as he goes. He then allows everyone back into the room where he announces that Trump won.

Democrats howl: “That’s outrageous! Show us the ballots”! Pence says, “Sorry, you don’t have standing to look at the ballots”.

This sounds very interesting. If they don’t like it, let them SUE! They wouldn’t dare do it because the evidence would come out.

Put simply, both sides show up (metaphorically) and it is decided which is legit.

If it looks like this could happen in January, shorting the market with a tiny hedge would be a real moneymaker.

I don’t think it will matter unless it’s the state legislatures choosing the electors.
Can I pick some too?
