Then there’s that little matter of the case still not having been dismissed. Sound familiar?

There’s a legitimate legal question here about whether there’s even any charges to be dismissed anymore. This came up in the Joe Arpaio case a while back. He was given a pardon while his appeal of his original conviction was in process. The judges hearing the appeal wanted to drop the case from their docket BUT HE FOUGHT IT. I believe he was successful in keeping his case alive by contending that he would rather be exonerated than pardoned.
