The point is that if you direct particular voters to use particular pens... those votes become IDENTIFIABLE... and thus subject to corrupt acts by elections staff.
The violation is a violation of the rights of those voters, whose votes are MADE DIFFERENTIABLE from other voters votes... thus violating their right to equal protection.
