"Why is that constitutionally questionable?"

First, the Founding States expressly constitutionally gave the states only limited power to make laws for federal elections, evidenced by the Constitution's Article I, Section 4, Clause 1 (1.4.1).

"Article I, Section 4, Clause 1: The Times, Places and Manner of holding Elections [emphasis added] for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the Places of chusing Senators."

But for argument's sake, let's say that 1.4.1 can be interpreted as giving the states the power to make election-related laws like recall laws for example.

More specifically, consider voters having "buyer's remorse” after the fact when they find that their "rock star” federal senator, for example, is not up to the job.

But the constitutional reality is that the Supreme Court had decided in U.S. Term Limits, Inc. v. Thornton that the states cannot make laws that limit constitutionally enumerated term limits regardless of 1.4.1 (my wording).

Also, in contrast to 1.4.1 at least giving some renegade states the hope of winning a renegade Senate seat, the 17th Amendment (17A) doesn't expressly give the states any flexibility to “facilitate” the election process, the 50% law effectively abridging voting power imo.

Excerpted from 17th Amendment: "The Senate of the United States shall be composed of two Senators from each State, elected by the people thereof [emphasis added], for six years; and each Senator shall have one vote. The electors in each State shall have the qualifications requisite for electors of the most numerous branch of the State legislatures."

In fact, noting that 17A didn't exist when the 14th Amendment (14A) was ratified, 17A arguably should have included a provision like Section 2 of 14A to punish renegade states that cheat the ballot box.

For example, 17A maybe should have increased the number of senators for each state, let's say the same even number of senators for each state, that amendment also reducing a state’s senators for punishment, like Sec. 2 of 14A does for representatives, when a states's desperate Democrats cheat the ballot box.

On the other hand, the fix for the ill-conceived 17A is to repeal it imo. (The 16th Amendment can disappear too.)

That’s ok. They are making sure our President doesn’t win Georgia and in 2022 you can bet, Stacey Abrams will be Governor and Kemp and Duncan will be out. Karma.
