Totally different issue. The 4-4 decision he is talking about was before the election. Alito’s order to separate the votes was actually a day or 2 after election day.
It all seems to heading in this direction. The Pennsylvania legislature chooses to send the Trump electors for the Electoral College and the Democrat administration and PA secretary of state chooses the Biden Electors. Therefore TWO sets of Electors and the U.S. Supreme Court has to decide which set to allow. The question comes as to the constitutional right of the state legislature to choose the electors which in turn hinges on if their finding of a VIOLATION of state election laws is valid. And I think we know the more than OBVIOUS answer to the latter.
