This might stick as a charge. Murder One would be sketchier.
Dolloff, having reached for Keltner's weapon (or the spray) WAS INSTIGATING.
Keltner slapping away Dolloff's reach WAS self defense.
In fact the video shows that Keltner deployed the spray IN RESPONSE TO Dolloff drawing his weapon.
The video also shows Dolloff reaching for his weapon as Keltner is slapping him away.
Dolloff is guilty of Second Degree Murder.
Hmm, how about the guy who seemed to be trying to rile up people for TV station footage? Im interested in what the prosecution might find during discovery as far as this being a coordinated scheme.

Agree that Murder 2 seems more appropriate, but IIRC, the Denver DA is owned by Soros. Which means that, just like the Eric Clanton case, they’ll probably wait a bit and drop the charge completely.
Let us not forget that the Chief of Police marched with the BLM and Antifa.
Dolloff will probably have a team of high-powered lawyers who will turn the court into a 3-ring circus to obscure the facts.
Never take Mace to a gun fight. You’ll lose every time.
Ya can’t shoot someone to death for spraying you with pepper spray....Otherwise people would be shooting cops every day for doing the same thing.
After various court delays the charge will be plea-bargained down to littering and creating a nuisance, and Dolloff will be sentenced to go sit for an hour on the Group W bench.
Dolloff looks like he weighs about 150 pounds. Who would hire an unarmed 150-pounder as body security?
TEGNA broadcasting, call your attorney. KUSA channel 9, please call your attorney....
The deceased relatives are looking at that TV station for a a BIG payday.
the station said it had directed the security guards not be armed and noone on the crew was aware that the ‘guard’ was armed. The guard was also unlicensed, that is, not legally working, which implicates both Pinkerton and the subcontractor they used to source said “guard’.
Guilty as sin. Bring on the wheelbarrows of cash.
btw, a ‘soup’ drive is to collect (actual, unopened) soup cans to throw at police - a spinoff from Portland tactics, where cop-debasing labels have been printed to paste on the cans:
“Protesters had been leaving the area following two demonstrationsa “Patriot Muster” and a “BLM-Antifa Soup Drive” counterprotestwhen the shooting occurred.
I’ve posted this before, but my inside sources tell me that Clark’s NOT liked by most of his coworkers at 9News.
Theyre shooting them for less.
Not entirely true.
If the one using the spray is using it as a prelude to a further attack.
One could be justified in using deadly force top protect oneself.
As far as the police they have exceptions that allow them to use reasonable force and not be attack for it..
I guess as far as the Denver shooting goes (not pepper spray use in general), photos show Mr. Keltner was actively backing away from the shooter, and police officers were only a few feet away. So, it might be difficult for the shooter to reasonably argue that he considered pepper spray to be a prelude to further attack. And video/stills from the scene (and probably the photos that were withheld by the Denver Post, to promote their pro-Dolloff narrative) show the unlicensed 'security guard' (Dolloff) drawing a bead on Mr. Keltner, before any pepper spray was released...
And yes, If you're running at me, spraying pepper spray at me while holding a knife or gun, I'd drop you like a bad habit.
But this wasn't the case, was it?
