I have read the indictment, in detail. You are correct, and it looks bad. However, the key is to ask what is missing from the indictment. I will suspect that the defense will come up with a story to explain these transactions. Fortunately, the DOJ doesn’t get to decide and the court will need to sort out the differences between the prosecution and the defense, and we have yet to hear from the defense.
I’m not trying to defend Bannon. He could have avoided all of this and done it legally by documenting his actions, but he didn’t bother and he tried to conceal what he was doing. However, it would be a mistake to say that the SDNY is just trying to protect the people of the United States and our rule of law. They aren’t, they are trying to nail a political opponent. Bannon gave them everything they needed.

If there was an agreement to pay Kolfage and to keep it hidden from view, then that moves into a new arena with regard to the functioning of the 503(c) and the donors; explicit in the fundraising effort was the promise by Kolfage that he wouldn't receive any money. (Whether or not he should have received compensation is beside the point; I understand that the man lost three limbs while serving his country.)
Many people are under the assumption that surreptitious movement of money is only criminal if it can be tied to an actual crime; this is simply not true. The movement of the money may be criminal in and of itself. The indictment for the intent to commit wire fraud, for example, refers to fake invoices drawn up to make the wire activity appear to be for a credible purpose other than a direct payment to an individual; this would be a crime whether or not donors appeared who claimed to be injured parties.
You are right, and the SDNY’s case rests on this argument. Pales in comparison to the crimes of the Clinton Foundation and their big honchos, but I also understand that we have several standards of justice in effect.

That aside, I do have a few liberal friends and a few Leftie Friends. We have an understanding that nothing will ever change each other’s minds, as long as it is cordial, we still talk. Some have been friends for many years. We don’t argue politics.

The case is being handled by the Office’s Public Corruption Unit. Assistant United States Attorneys Nicolas Roos, Alison G. Moe, and Robert B. Sobelman are in charge of the prosecution.
The charges contained in the Indictment are merely accusations. The defendants are presumed innocent unless and until proven guilty.

It's not a lawsuit, it's a criminal prosecution in a Federal Court. The conviction rate in that arena is north of 90%. Bannon is in deep doo doo. But, I think that the prosecution is counting on Koflage to take a plea bargain and turn on Bannon. I doubt that it happens, so they might cave, once the camera shows a three amputee combat veteran going into the court house. This will be a fight, the people in the SDNY are insane and beyond partisan.

Yes. I once had a friend on Twitter who I developed some respect for. He finally admitted to me he was a Federal Judge but had many years of Federal law enforcement experience. His father was a SDNY policeman before him. He was not as knowledgeable about firearms as you would have thought he was. People in NY in general are a different bred of cat.
One day I retweeted a derogatory remark someone made about James Comey and he blocked me. End of conversation.
